【摘要】：全球化時(shí)代的到來(lái)，國(guó)際和國(guó)內(nèi)環(huán)境的日益變化，使我們面臨著眾多新的課題。雙重國(guó)籍問(wèn)題做為近年來(lái)各國(guó)國(guó)籍立法變革的焦點(diǎn)，在我國(guó)也引起了眾多學(xué)者和僑界人士的關(guān)注。我國(guó)是否有必要和可能承認(rèn)雙重國(guó)籍，以及采用何種模式承認(rèn)雙重國(guó)籍，具體在規(guī)則設(shè)計(jì)上如何安排等都成了探討的焦點(diǎn)。筆者在總結(jié)各家之長(zhǎng)的基礎(chǔ)上，采用比較分析、歷史分析、法條分析、案例分析和法律移植等方法，旨在通過(guò)對(duì)各國(guó)雙重國(guó)籍制度的研究分析和對(duì)比，結(jié)合我國(guó)國(guó)籍制度的現(xiàn)狀、背景，設(shè)計(jì)出符合我國(guó)國(guó)情的雙重國(guó)籍制度。 本文從基本理論著手，分三個(gè)部分進(jìn)行闡述：第一部分，研究和分析了雙重國(guó)籍、雙重國(guó)籍制度及其歷史發(fā)展；第二部分，選取有典型意義的實(shí)行雙重國(guó)籍制度的三個(gè)國(guó)家：美國(guó)、德國(guó)、意大利，對(duì)其雙重國(guó)籍制度的產(chǎn)生及發(fā)展、模式選擇和規(guī)則設(shè)計(jì)進(jìn)行了分析和評(píng)述，總結(jié)出其中的利弊；最后一部分，分析了我國(guó)國(guó)籍制度產(chǎn)生的背景和現(xiàn)狀，對(duì)我國(guó)實(shí)行雙重國(guó)籍制度的必要性以及模式選擇和具體規(guī)則設(shè)計(jì)提出了自己的看法和建議。
[Abstract]:With the coming of globalization and the change of international and domestic environment, we are faced with many new problems. As the focus of national nationality legislation reform in recent years, the issue of dual nationality has also attracted the attention of many scholars and overseas Chinese in China. Whether it is necessary or possible to recognize dual nationality in our country and what mode it adopts to recognize dual nationality and how to arrange it in the design of rules have become the focus of discussion. On the basis of summarizing the merits of various countries, the author adopts the methods of comparative analysis, historical analysis, legal article analysis, case analysis and legal transplantation, aiming at analyzing and comparing the dual nationality systems of various countries. Combined with the present situation and background of the nationality system in China, the dual nationality system is designed in accordance with the national conditions of our country. This article starts from the basic theory, divides into three parts to carry on the elaboration: the first part, has studied and analyzed the dual nationality, the dual nationality system and its historical development, the second part, This paper selects three countries with typical meaning to implement dual nationality system: the United States, Germany and Italy, analyzes and comments on the emergence and development of dual nationality system, mode selection and rule design, and summarizes the advantages and disadvantages. In the last part, the author analyzes the background and present situation of Chinese nationality system, and puts forward his own views and suggestions on the necessity of implementing dual nationality system, the choice of mode and the design of specific rules.
