【摘要】：當(dāng)前我國境外流失文物追索工作取得了突出成績,但整體效果并不理想。在此背景下,理清和反思我國境外流失文物追索的現(xiàn)狀,對于推動(dòng)我國流失文物追索工作的開展具有重要意義。具體可以從以下方面進(jìn)行完善:加強(qiáng)對于境外流失文物追索的研究,注重提高研究的針對性和可操作性;突出刑事司法合作在追索中的重要地位,拓展追索的方式和渠道;逐步推進(jìn)中國視角下國際文物公約的發(fā)展與國際視角下中國文物立法的完善;密切關(guān)注他國文物立法,針對不同國家擬制不同的追索方案;促進(jìn)專門追索機(jī)構(gòu)的構(gòu)建與信息傳遞渠道的通暢;開展全面文物普查,健全文物信息檔案庫和文物管理制度。
[Abstract]:At present, the overseas lost cultural relics recovery has made outstanding achievements, but the overall effect is not ideal. Under this background, it is of great significance to clear up and reflect on the status quo of the lost cultural relics recovery in our country, which is of great significance to promote the recovery of lost cultural relics in our country. It can be perfected from the following aspects: strengthening the research on the overseas lost cultural relics, focusing on improving the pertinence and maneuverability of the research, highlighting the important position of the criminal judicial cooperation in the recourse, expanding the way and channel of the recovery; Gradually promote the development of the international cultural relic convention from the Chinese perspective and the perfection of the Chinese cultural relic legislation from the international perspective, pay close attention to the legislation of other countries' cultural relics, and draw up different recourse schemes for different countries; We will promote the establishment of specialized recourse institutions and the unobstructed channels of information transmission, carry out a comprehensive survey of cultural relics, and improve the archives of cultural relics information and the system of cultural relics management.
