【摘要】：隨著經(jīng)濟(jì)全球化帶動世界各個國家在政治、文化等方面的交流與合作，涉外婚姻的數(shù)量不斷增加,引起的法律糾紛也大大增多，但是，由于各國的政治制度、經(jīng)濟(jì)狀況、歷史傳統(tǒng)、社會風(fēng)俗、宗教信仰等不同，對涉外婚姻、家庭、繼承的相關(guān)立法規(guī)定通常也有差異，從而產(chǎn)生一些法律沖突。大多數(shù)國家遵循國際法和國際私法的一般原則優(yōu)先適用，這樣才能使涉外婚姻、家庭、繼承案件得到順利的解決,而我國也為維護(hù)我國國家主權(quán),保護(hù)我國國家、集體和公民個人的正當(dāng)權(quán)益,促進(jìn)我國與世界各國的友好交往而努力，規(guī)定了科學(xué)而周嚴(yán)的立法。2011年4月1日《中華人民共和國涉外民事關(guān)系法律適用法》的實施，該法律適用法已經(jīng)受到越來越多人的關(guān)注，本文通過四個部分對涉外婚姻、家庭和繼承的概述、理論立法、實務(wù)問題和立法建議等方面進(jìn)行了闡述。
[Abstract]:With the economic globalization driving the political and cultural exchanges and cooperation among all countries in the world, the number of foreign-related marriages has been increasing and the number of legal disputes has greatly increased. However, due to the political systems of various countries, the economic situation, Historical traditions, social customs, religious beliefs and other differences, foreign marriage, family, inheritance of the relevant legislative provisions are usually different, resulting in some conflicts of laws. Most countries follow the general principles of international law and private international law to give priority to the application, so that foreign marriage, family and succession cases can be resolved smoothly, and China is also in order to safeguard our national sovereignty and protect our country. The legitimate rights and interests of the collective and individual citizens, and the efforts to promote friendly exchanges between China and other countries in the world, have stipulated scientific and strict legislation. The implementation of the Law of the people's Republic of China on the Application of the Law on Foreign Civil Relations on April 1, 2011, The application of the law has been paid more and more attention. This paper expounds the foreign marriage, family and inheritance, theoretical legislation, practical issues and legislative suggestions through four parts.
