【摘要】：對(duì)未成年人的網(wǎng)絡(luò)合法權(quán)益保護(hù)問(wèn)題是保護(hù)未成年人領(lǐng)域及網(wǎng)絡(luò)領(lǐng)域都極為重要的法律問(wèn)題,但是,對(duì)未成年人保護(hù)的立法基本是從將未成年人作為保護(hù)的客體予以確定的。實(shí)際上,互聯(lián)網(wǎng)日漸成為未成年人社會(huì)參與、行使言論權(quán)的重要平臺(tái),他們作為言論發(fā)布者的主體地位應(yīng)予以確定,他們的合法網(wǎng)絡(luò)言論應(yīng)予以保護(hù),涉及未成年人網(wǎng)絡(luò)言論的立法工作應(yīng)盡快進(jìn)行。為此,基于未成年人作為網(wǎng)絡(luò)言論發(fā)布者的保護(hù)維度,保護(hù)未成年人網(wǎng)絡(luò)言論應(yīng)融入到構(gòu)建未成年人法律體系中去進(jìn)行戰(zhàn)略性規(guī)劃,準(zhǔn)確把握技術(shù)與法律的平衡,全面提高立法層次,使相關(guān)法律法規(guī)更具操作性以尋求司法保護(hù)。
[Abstract]:The protection of the legal rights and interests of minors on the network is an extremely important legal issue in the field of protection of minors and in the field of the network. However, the legislation for the protection of minors is basically determined from the protection of minors as the object of protection. In fact, the Internet is becoming an important platform for minors to participate in society and exercise their right of expression. Their main status as publishers of speech should be determined, and their legitimate online speech should be protected. The legislation concerning minors'online speech should be carried out as soon as possible. Therefore, based on the dimension of protection of minors as publishers of network speech, the protection of minors' online speech should be integrated into the construction of minors' legal system to carry out strategic planning and accurately grasp the balance between technology and law. Improve the level of legislation, make the relevant laws and regulations more operational in order to seek judicial protection.
