【摘要】：國際私法中的反法律規(guī)避制度具有恢復(fù)法律適用秩序原狀與遏制不當(dāng)?shù)美p重功能。法律規(guī)避預(yù)設(shè)了本然法與實(shí)然法、不利法與有利法這兩對范疇之間的對應(yīng)關(guān)系,但這兩對范疇完全存在逆轉(zhuǎn)的可能。傳統(tǒng)功能定位下的反法律規(guī)避制度無法對錯(cuò)置適用本然法與實(shí)然法所產(chǎn)生的不當(dāng)?shù)煤驘o利害效果的規(guī)避行為進(jìn)行救濟(jì)。必須將反法律規(guī)避制度的功能調(diào)整為單一的恢復(fù)法律適用秩序之原狀,方可完整救濟(jì)一切利用沖突規(guī)范進(jìn)行法律規(guī)避的行為。反法律規(guī)避制度的功能應(yīng)指向更高的意境,成為實(shí)現(xiàn)法律趨同的原動(dòng)力與杠桿。
[Abstract]:The anti-law evasion system in private international law has the dual functions of restoring the order of legal application and restraining improper enrichment. The legal circumvention presupposes the corresponding relationship between the two pairs of categories, namely, the original law and the actual law, the unfavorable law and the favorable law, but the two pairs of categories may be reversed completely. Under the traditional function orientation, the anti-law circumvention system can not remedy the improper harm or the non-benefit evading behavior caused by the application of the original law and the real law. Only by adjusting the function of the anti-law circumvention system to the original state of restoring the applicable order of law can we completely remedy all the behaviors of using conflict norms to circumvent the law. The function of anti-law evading system should point to higher artistic conception and become the motive force and lever to realize legal convergence.
