【摘要】：隨著地球資源短缺問題的日益突出,月球以其豐富的資源和近地性不斷吸引著人類的開發(fā)和探索,然而國際社會目前還缺乏一套完整的、統(tǒng)一的、有約束力的法律體制。從現(xiàn)有的國際公共領(lǐng)域資源開發(fā)法律體制和現(xiàn)有月球開發(fā)法律規(guī)范的研究出發(fā),建議在月球開發(fā)法律體制的構(gòu)建中,以開發(fā)的不同時期為維度,以便為構(gòu)建月球開發(fā)新的法律體制獻言獻策,進而為各國的月球開發(fā)活動提供一些參考性的指導。
[Abstract]:With the increasing shortage of the earth's resources, the moon is attracting the development and exploration of mankind for its rich resources and near earth. However, the international community still lacks a complete, unified and binding legal system. Based on the study of the existing legal system of international public domain resource development and the existing legal norms of lunar exploitation, it is suggested that in the construction of the legal system of lunar exploitation, the different periods of development should be taken as the dimension. In order to build a new legal system for the development of the moon to provide advice, and then provide some reference guidance for the development of the moon in various countries.
