TBT協(xié)定“國際標準”的法律解釋及其改進路徑

【摘要】："國際標準"是TBT協(xié)定中的重要概念,但TBT協(xié)定并未對其進行明確定義。因此,要使TBT協(xié)定相關條款得以施行,就需要對"國際標準"進行準確的法律解釋。本文在總結WTO爭端解決機構認定"國際標準"要件的基礎上,梳理技術性貿易壁壘規(guī)制的歷史演變,縱向考察"國際標準"的定義由明確轉變?yōu)槟：倪^程,從中探析TBT協(xié)定的立法原意。結合法經濟學的"成本-收益"分析視角,本文認為實現(xiàn)WTO成員利益最大化應是解釋"國際標準"的基準,并提出了改進"國際標準"法律解釋的若干意見。
[Abstract]:International standard is an important concept in TBT protocol, but it is not clearly defined in TBT protocol. Therefore, in order to implement the relevant provisions of the TBT Agreement, it is necessary to interpret the International Standard accurately. On the basis of summing up the requirements of WTO dispute settlement bodies' recognition of "international standards", this paper combs the historical evolution of the regulation of technical barriers to trade, and investigates the definition of "international standards" from a clear to a vague process. From the analysis of the legislative intent of the TBT Agreement. From the perspective of cost-benefit analysis of law and economics, this paper holds that maximizing the benefits of WTO members should be the basis for interpreting "international standards", and puts forward some suggestions to improve the legal interpretation of "international standards".
