【摘要】：網(wǎng)絡(luò)深層鏈接是否屬于向公眾提供,在理論界與實務(wù)界存有較大爭議。在國內(nèi),有"服務(wù)器標準"與"實質(zhì)呈現(xiàn)標準"的對立;在歐盟,有"新公眾標準"與"特殊技術(shù)手段標準"之爭。通過應(yīng)用法律解釋學(xué)的方法,對國際版權(quán)公約規(guī)定的"向公眾提供權(quán)"進行充分闡釋,提出"間接提供理論",即"向公眾提供權(quán)"既包括向公眾直接提供的行為,也包括向公眾間接提供的行為,后者可以作為規(guī)制深層鏈接的理論依據(jù)。
[Abstract]:Whether the deep link is to be provided to the public is controversial in the theoretical and practical circles. In China, there is a contradiction between "server standard" and "substantial presentation standard"; in EU, there is a dispute between "new public standard" and "special technical means standard". By applying the method of legal hermeneutics, the "right to provide to the public" stipulated by the international copyright convention is fully explained, and the "theory of indirect provision" is put forward, that is, the "right to provide to the public" includes the act of offering directly to the public. It also includes the behavior provided indirectly to the public, which can be used as the theoretical basis for regulating deep links.
