【摘要】：流浪兒童問(wèn)題是世界性的難題,中國(guó)的流浪兒童問(wèn)題的解決也到了刻不容緩的地步。兒童是祖國(guó)的未來(lái),其生存與發(fā)展?fàn)顩r直接影響到國(guó)民素質(zhì)的提高和國(guó)民經(jīng)濟(jì)的持續(xù)、穩(wěn)定、快速發(fā)展以及社會(huì)的安定和諧。近年來(lái),由于城市與農(nóng)村間流動(dòng)人口的增加、家庭不穩(wěn)定等因素的影響,流浪兒童的數(shù)量不斷增加,他們的生存狀況及對(duì)社會(huì)的影響已成為青少年保護(hù)和社會(huì)治安綜合治理工作中的一個(gè)突出問(wèn)題。關(guān)注流浪兒童,維護(hù)其合法權(quán)益,使之回歸溫馨社會(huì),應(yīng)成為政府和社會(huì)重點(diǎn)關(guān)注和優(yōu)先解決的社會(huì)問(wèn)題之一。 流浪兒童的保護(hù)救助不是一個(gè)簡(jiǎn)單的技術(shù)和方法問(wèn)題,流浪兒童救助保護(hù)工作是從預(yù)防、保護(hù)、救助、管理、教育到安置回歸的一個(gè)綜合系統(tǒng)的工作。這一工作需要眾多機(jī)構(gòu)和部門的參與、協(xié)調(diào)和配合開展。而目前我國(guó)流浪兒童救助保護(hù)難問(wèn)題的根本原因在于法律缺位。盡管我國(guó)有關(guān)流浪兒童權(quán)益保護(hù)的法律法規(guī)不在少數(shù),但是存在諸如法律位階不高、可操作性不強(qiáng)等問(wèn)題,總的來(lái)講我國(guó)尚未形成環(huán)環(huán)相扣、縝密完善的未成年人政策法律體系,因此,有關(guān)流浪兒童的預(yù)防、救助和安置等工作缺少一個(gè)賴以立足的法律和制度平臺(tái)。而缺乏法律的支持與指導(dǎo),流浪兒童的救助保護(hù)工作就無(wú)法順利有效地進(jìn)行,其權(quán)利保障也無(wú)法最終順利得以實(shí)現(xiàn),因此,進(jìn)一步完善現(xiàn)有的法律法規(guī)、制定專門的流浪兒童救助保護(hù)法律就成為解決問(wèn)題的最終落腳點(diǎn)。
[Abstract]:The problem of street children is a worldwide problem, and it is urgent to solve the problem of street children in China. Children are the future of the motherland, their survival and development directly affect the improvement of national quality and the sustained, stable, rapid development and social stability and harmony of the national economy. In recent years, the number of street children has been increasing as a result of the increase in the floating population between urban and rural areas and the influence of factors such as family instability. Their living conditions and their influence on society have become a prominent problem in the comprehensive management of youth protection and social security. Paying attention to street children, safeguarding their legal rights and interests and returning them to a warm society should be one of the social problems that the government and society should pay attention to and give priority to solve. The protection and rescue of street children is not a simple technical and methodological problem. The rescue and protection of street children is a comprehensive system from prevention, protection, rescue, management, education to resettlement and return. This work requires the participation, coordination and cooperation of many agencies and departments. At present, the fundamental reason for the difficulty of rescuing and protecting street children in our country lies in the absence of law. Although there are not a few laws and regulations concerning the protection of the rights and interests of street children in China, there are still problems such as low legal rank and low operability. Generally speaking, our country has not yet formed a link. Therefore, the prevention, relief and resettlement of street children are lack of a legal and institutional platform based on. Without legal support and guidance, the relief and protection work for street children cannot be carried out smoothly and effectively, and the protection of their rights will not be realized successfully. Therefore, the existing laws and regulations should be further improved. The establishment of a special law on the rescue and protection of street children has become the ultimate solution to the problem.
