【摘要】：國(guó)際海上貨物承運(yùn)人責(zé)任基礎(chǔ)規(guī)則并非完全來(lái)自于實(shí)然,來(lái)自于基于效益的目的理性,若根本不以正義為目的,未經(jīng)法律價(jià)值評(píng)價(jià),純粹基于效用與發(fā)展國(guó)際航運(yùn)經(jīng)濟(jì)的目的理性,不可能得到一個(gè)國(guó)際航運(yùn)秩序的"應(yīng)然"法律規(guī)范,亦即表達(dá)一項(xiàng)"應(yīng)然"的航運(yùn)法律概念。而純粹脫離國(guó)際航運(yùn)實(shí)踐效用目的,僅依憑法律價(jià)值的"應(yīng)然"本身,亦不可能創(chuàng)造出能夠有效調(diào)整國(guó)際航運(yùn)實(shí)踐的法律秩序。只有把價(jià)值與航運(yùn)事實(shí)目的,應(yīng)然與實(shí)然,彼此相互對(duì)應(yīng),即把基于效用的目的理性的構(gòu)成同確保基于正義的價(jià)值實(shí)現(xiàn),這兩方面協(xié)調(diào)起來(lái),才能產(chǎn)生真正實(shí)際有效的和相對(duì)符合正義的國(guó)際海上貨物承運(yùn)人責(zé)任基礎(chǔ)法律體系。
[Abstract]:The basic rules of the liability of the international carrier of goods by sea do not come from reality, but from the reason of purpose based on benefit. If the purpose is not justice at all, the value of law is not evaluated. Based on the objective rationality of utility and development of international shipping economy, it is impossible to obtain a legal norm of "ought to be" of international shipping order, that is to say, to express a legal concept of "ought to be". However, it is impossible to create a legal order which can effectively adjust the practice of international shipping by merely relying on the "ought to be" of the legal value to break away from the purpose of the utility of international shipping practice. Only by reconciling value with the actual purpose of shipping, between what should be and what is real, that is, by reconciling the rational composition of the purpose based on utility with that of ensuring the realization of value based on justice, In order to produce a truly effective and relatively just international maritime cargo carrier liability basic legal system.
