【摘要】：全球氣候變暖是人類面臨的最為迫切的全球性問題之一,減排溫室氣體、應(yīng)對全球氣候變暖及其產(chǎn)生的不良影響已成為世界各國和國際組織的一致共識。目前碳減排機制以《聯(lián)合國氣候變化框架公約》和《京都議定書》為核心,但由于其關(guān)鍵性條款存在一定模糊性以及法律約束力的缺乏,使碳減排合作存在實施和執(zhí)行等諸多困難。 世界貿(mào)易組織(WT0)作為普遍被接受并遵守的國際性經(jīng)濟組織,是具有國際碳減排合作的基礎(chǔ)的。因為,加入世界貿(mào)易組織必須接受其“一攬子”協(xié)議。如果將國際碳減排合作機制引入WT0的“一攬子”協(xié)議中,成為世界上更多國家經(jīng)濟貿(mào)易的組成部分,那么“碳排放”的問題必然會得到更好的解決,困擾人類社會發(fā)展的巨大問題必然也會得到適當?shù)囊种啤?論文分為五章 第一章導(dǎo)論,介紹論文研究的目的和意義,通過國內(nèi)外研究綜述的分析講述論文的結(jié)構(gòu)、創(chuàng)新點和研究方法。 第二章是通過經(jīng)濟學(xué)理論、外部性理論和國際法學(xué)理論層面的分析,用進入低碳經(jīng)濟時代的全球經(jīng)濟現(xiàn)狀結(jié)合世界各國所展開的環(huán)境政治、環(huán)境外交的行動,闡述WTO框架下建立碳減排合作機制的理論基礎(chǔ)。 第三章通過碳減排機制的現(xiàn)實困境、操作性困難和與能夠與WTO規(guī)定對接的條款,來說明將國際碳減排機制引入WTO多邊貿(mào)易體制的必要性和可行性。 第四章是WTO框架下建立碳減排機制的設(shè)想,本章通過完善現(xiàn)有制度下的WTO貿(mào)易與環(huán)境機制,引入碳排放權(quán)交易體系和碳稅、能源稅進入WTO多邊貿(mào)易體制的做法,以及在相關(guān)協(xié)定中創(chuàng)設(shè)氣候條款的辦法建立WTO框架下的國際碳減排合作機制。 第五章是WTO框架下碳減排機制的建立對我國的影響和應(yīng)對,也是對中國未來的啟示。
[Abstract]:Global warming is one of the most urgent global problems facing mankind. It has become the consensus of all countries and international organizations to reduce greenhouse gases and cope with global warming and its adverse effects. At present, the carbon abatement mechanism is based on the United Nations Framework Convention on Climate change and the Kyoto Protocol. However, due to the ambiguity of its key provisions and the lack of legally binding force, So that carbon emission reduction cooperation exists in the implementation and implementation of a lot of difficulties. The World Trade Organization (WT0), as an international economic organization that is generally accepted and respected, is the foundation of international carbon reduction cooperation. Because accession to the World Trade Organization must accept its "package" agreement. If the international carbon abatement cooperation mechanism is introduced into the "package" agreement of WT0 and becomes an integral part of the economy and trade of more countries in the world, then the problem of "carbon emissions" will inevitably be better solved. The enormous problems that haunt the development of human society must also be properly suppressed. The paper is divided into five chapters: the first chapter introduces the purpose and significance of the research, and describes the structure, innovation and research methods of the thesis through the analysis of the domestic and foreign research summary. The second chapter is through the economic theory, the externality theory and the international legal theory plane analysis, uses the global economy present situation which enters the low carbon economy time unifies the environment politics, the environment diplomacy action which the world countries launches. This paper expounds the theoretical basis of establishing the cooperation mechanism of carbon emission reduction under the framework of WTO. The third chapter explains the necessity and feasibility of introducing the international carbon emission reduction mechanism into the multilateral trading system of WTO through the realistic predicament of the carbon abatement mechanism, the difficulty of operation and the provisions that can be connected with the WTO regulations. Chapter four is the assumption of establishing carbon abatement mechanism under WTO framework. This chapter introduces carbon emission trading system and carbon tax, and energy tax into the multilateral trading system of WTO by perfecting the WTO trade and environment mechanism under the existing system. And the establishment of climate provisions in the relevant agreements to establish the WTO framework of international carbon emission reduction cooperation mechanism. The fifth chapter is the influence and response of the establishment of carbon abatement mechanism under WTO framework to our country, and it is also the inspiration to China's future.
