【摘要】：中越兩國(guó)相鄰,邊民的跨國(guó)通婚狀況早就存在,他們語(yǔ)言相通,文化相近,生活習(xí)慣差異不大,貨幣在邊貿(mào)地區(qū)也是可以彼此自由流通的。中國(guó)一東盟自由貿(mào)易區(qū)的建立、發(fā)展和繁榮,促進(jìn)了兩國(guó)邊民之間的交流和融合。隨著中越兩國(guó)人民之間交往日益頻繁,涉外婚姻的數(shù)量呈上升趨勢(shì)。但是,中越邊民的通婚現(xiàn)狀還存在一些問(wèn)題,這些問(wèn)題為政府部門(mén)的管理帶來(lái)困擾,同時(shí)也為邊民所關(guān)注,影響他們的切身利益。因此,本調(diào)研報(bào)告旨在了解我國(guó)邊民跨國(guó)通婚的現(xiàn)狀和我國(guó)法律在中越邊民通婚的適用狀況,進(jìn)一步了解相關(guān)情況,進(jìn)而找出問(wèn)題根源,完善邊民通婚的法律問(wèn)題,維護(hù)中越邊民跨國(guó)婚姻家庭的穩(wěn)定和利益,推進(jìn)邊境婚姻的法制建設(shè)。 在調(diào)研中,我們相繼走訪了憑祥市、崇左市、寧明縣那堪鄉(xiāng)等地,對(duì)當(dāng)?shù)氐拿裾�、派出所進(jìn)行了相關(guān)政策和數(shù)據(jù)的了解,對(duì)跨國(guó)通婚的邊民家庭情況進(jìn)行了細(xì)致的采訪和深入的了解。通過(guò)數(shù)據(jù)和材料總結(jié)出中越邊民通婚的主要狀況：近年來(lái),隨著越南的生活條件改善和經(jīng)濟(jì)的恢復(fù),越南婦女因?yàn)樨毨Ф薜轿覈?guó)農(nóng)村的人數(shù)呈下降趨勢(shì)；但與此同時(shí),邊民進(jìn)行登記的結(jié)婚數(shù)量也呈緩慢增長(zhǎng)趨勢(shì)。非法婚姻不僅本身存在很多弊端,同時(shí)也帶來(lái)很多的問(wèn)題,主要表現(xiàn)在：嫁過(guò)來(lái)的越南婦女不能取得中國(guó)國(guó)籍；不利于保障嫁入我國(guó)越南婦女的權(quán)益；嚴(yán)重影響了邊境地區(qū)的社會(huì)治安管理；影響我國(guó)的計(jì)劃生育政策和家庭的穩(wěn)定；非法婚姻給政府部門(mén)的管理造成了很大的阻礙。 通過(guò)研究和分析,非法婚姻問(wèn)題的存在原因主要是由于邊境地區(qū)經(jīng)濟(jì)水平的限制；邊民法律意識(shí)的淡薄和跨國(guó)婚姻的辦理手續(xù)的繁瑣。因此,通過(guò)現(xiàn)狀的分析和原因的探究,我提出增進(jìn)上下交流,了解彼此需求；規(guī)范相關(guān)立法,加強(qiáng)雙邊合作；增強(qiáng)文化教育,加強(qiáng)經(jīng)濟(jì)建設(shè),開(kāi)放邊民思想：根據(jù)民族特色,發(fā)揮自治優(yōu)勢(shì)的四點(diǎn)建議。 中越邊民通婚法律問(wèn)題的完善,有利于邊境地區(qū)的長(zhǎng)治久安,有利于跨國(guó)婚姻家庭的幸福穩(wěn)定,有利于邊境婚姻管理制度的整體進(jìn)步,有利于建設(shè)具有中國(guó)特色的社會(huì)主義和諧社會(huì)。
[Abstract]:The border people of China and Vietnam have long had their intermarriage situation. They have the same language, similar culture, little difference in living habits, and the currency can circulate freely in the border trade area. The establishment, development and prosperity of China-ASEAN Free Trade area promoted the exchange and integration between the border people of the two countries. With the increasing exchanges between the Chinese and Vietnamese peoples, the number of foreign-related marriages is on the rise. However, there are still some problems in the intermarriage between the border people of China and Vietnam. These problems have troubled the management of the government, and have also been concerned by the border people and affected their vital interests. Therefore, the purpose of this research report is to understand the current situation of cross-border intermarriage among border people in China and the application of Chinese law in Sino-Vietnamese border marriage, to further understand the relevant situation, and then to find out the root causes of the problems, and to perfect the legal problems of border intermarriage. To safeguard the stability and interests of cross-border marriage and family, and to promote the legal construction of border marriage. In the course of the investigation, we visited Pingxiang City, Chongzuo City, Nakan Township of Ningming County and other places one after another, to understand the relevant policies and data of the local civil affairs bureau and police station. This paper makes a detailed interview and in-depth understanding of the families of border people who intermarry across the border. In recent years, with the improvement of living conditions and economic recovery in Vietnam, the number of Vietnamese women marrying to rural areas due to poverty is on the decline, but at the same time, Border people to register the number of marriages also showed a slow growth trend. Illegal marriage not only has many disadvantages, but also brings a lot of problems, such as: the Vietnamese women can not acquire Chinese nationality, the rights and interests of the Vietnamese women married into our country can not be safeguarded and the rights and interests of the Vietnamese women married into our country can not be protected. It has seriously affected the social security management in the border areas; affected the family planning policy and family stability in China; and the illegal marriage has caused great obstacles to the management of government departments. Through research and analysis, the reason for the existence of illegal marriage is mainly due to the limitation of economic level in border areas, the weak legal consciousness of border people and the cumbersome procedures for handling transnational marriages. Therefore, through the analysis of the current situation and the exploration of the reasons, I proposed to enhance exchanges between the top and bottom, to understand each other's needs, to standardize relevant legislation, to strengthen bilateral cooperation, to strengthen cultural education, to strengthen economic construction, and to open the frontier people's thinking: according to national characteristics, Four suggestions for giving full play to the advantages of autonomy. The perfection of the legal issues concerning the intermarriage between the border people of China and Vietnam is conducive to the long-term stability of the border areas, the happiness and stability of transnational marriage and families, and the overall progress of the border marriage management system. It is conducive to building a harmonious socialist society with Chinese characteristics.
