中國—東盟民事司法協(xié)助制度統(tǒng)一化問題研究

【摘要】:隨著中國-東盟自由貿易區(qū)的全面啟動,中國與東盟在各領域的合作不斷擴大和深入,尤其經(jīng)貿往來頻繁,邊貿糾紛日益增多,中國涉東盟各國民商事案件也逐年遞增。要解決這些涉外民商事訴訟,必然會涉及國際民事司法協(xié)助的各項制度,即域外送達、域外調查取證、外國法院民事判決或仲裁裁決的承認與執(zhí)行等,這些環(huán)節(jié)將直接影響到審判的進行及裁判的效力。但目前中國-東盟關于民事司法協(xié)助的立法還比較匱乏,中國僅與泰國、新加坡、越南、老撾四個東盟國家簽訂了有關民事司法協(xié)助的雙邊條約,而且條約內容還不夠全面,各國國內法的規(guī)定也存在較大差異,而實踐中更是效率低下甚至無法開展。 因此,本文以構建統(tǒng)一的中國-東盟民事司法協(xié)助制度為主旨,在由雙邊協(xié)定逐步過渡到多邊統(tǒng)一的民事司法協(xié)助公約這個統(tǒng)一化途徑的前提下,運用比較分析、文獻研究以及從宏觀到微觀的綜合分析方法,對如何統(tǒng)一和完善民事司法協(xié)助的各項制度提出了一些建議。全文分為四大部分: 引言,介紹了課題研究的背景、意義和國內外研究現(xiàn)狀。通過分析中國與東盟之間民事司法協(xié)助存在的問題,指出民事司法協(xié)助機制缺失和難以操作是其核心所在;通過介紹國內外在該領域的研究現(xiàn)狀,指出了統(tǒng)一和完善中國-東盟民事司法協(xié)助制度這一論題的重要性。 第一部分,對國際民事司法協(xié)助的基本理論進行介紹,包括國際民事司法協(xié)助的概念、范圍和基本原則,以及國際民事司法協(xié)助的依據(jù)。 第二部分,對構建統(tǒng)一的中國-東盟民事司法協(xié)助制度的必要性和可行性進行分析。以中國-東盟關系發(fā)展的現(xiàn)實需要和當前民事司法協(xié)助存在的問題來凸顯統(tǒng)一中國-東盟民事司法協(xié)助制度的必要性;以中國-東盟長期以來的交流合作和已有的法律協(xié)議以及其他國際組織統(tǒng)一民事司法協(xié)助制度的成功范式來證實其可行性;最后對構建統(tǒng)一的中國-東盟民事司法協(xié)助制度所面臨的幾個主要問題進行了分析。 第三部分,對統(tǒng)一中國-東盟民事司法協(xié)助制度的模式選擇進行了分析。通過對當前比較有代表性的三種統(tǒng)一民事司法協(xié)助立法模式進行比較分析之后,認為由雙邊協(xié)定逐步過渡到多邊統(tǒng)一的民事司法協(xié)助公約是當前比較適合中國-東盟自由貿易區(qū)的立法模式。 第四部分,在上文提出的由雙邊協(xié)定過渡到多邊公約的這一框架下對民事司法協(xié)助制度的各項具體內容進行構建和完善,即域外送達、域外取證、外國法院民事判決及外國仲裁裁決的承認與執(zhí)行這幾項制度,尤其是要把外國法院判決的承認與執(zhí)行納入到中國-東 盟的民事司法協(xié)助制度體系中來。鑒于達成綜合性的民事司法協(xié)助多邊公約比較困難,可以嘗試針對民事司法協(xié)助的各項制度分別達成專門性的公約。 最后部分為結論,對全文進行概括總結,在如何求同存異協(xié)調東盟各國達成統(tǒng)一的民事司法協(xié)助制度問題上進一步闡述了自己的看法,要求各國對國內法進行調整,在這個過程中可以借鑒美國示范法方式。最后概括強調了完善立法的過程中要注意的一些制度設計問題。
[Abstract]:With the full start of the China ASEAN Free Trade Area, the cooperation between China and ASEAN is expanding and deepening in various fields, especially the economic and trade exchanges, the increasing number of disputes over the border trade, and the increasing number of civil and commercial cases involving ASEAN in China. Degree, namely, extraterritorial delivery, extraterritorial investigation and forensics, the recognition and enforcement of civil judgments or arbitral awards of foreign courts, and so on. These links will directly affect the conduct of the trial and the effectiveness of the referees. However, the legislation of China ASEAN on civil judicial assistance is still scarce, and China has signed only four ASEAN countries in Thailand, Singapore, Vietnam and Laos. Bilateral treaties on civil judicial assistance have been booked, and the contents of the treaties are not comprehensive enough, and the provisions of domestic laws in various countries are also different. In practice, it is more inefficient or even impossible to carry out in practice.
Therefore, this paper, based on the establishment of a unified China ASEAN civil judicial assistance system, is based on a unified approach to the multilateral and unified civil judicial assistance convention from bilateral agreements, and uses comparative analysis, literature research and comprehensive analysis from macro to micro to how to unify and improve civil justice. There are some suggestions for the various systems of assistance. The full text is divided into four parts:
This paper introduces the background, significance and present situation of research at home and abroad. Through the analysis of the existing problems of civil judicial assistance between China and ASEAN, it points out that the lack and difficulty of the civil judicial assistance mechanism is its core. By introducing the research status in this field at home and abroad, it points out the unification and improvement of the Chinese ASEAN people. The importance of the issue of the system of judicial assistance.
In the first part, the basic theories of international civil judicial assistance are introduced, including the concept, scope and basic principles of international civil judicial assistance, as well as the basis for international civil judicial assistance.
In the second part, the necessity and feasibility of building a unified China ASEAN civil judicial assistance system is analyzed. The necessity of unified China ASEAN civil judicial assistance system is highlighted by the practical needs of the development of China ASEAN Relations and the existing problems of the current civil judicial assistance. On the basis of the existing legal agreements and the successful paradigm of the unified civil judicial assistance system of other international organizations, it confirms its feasibility, and finally analyzes several major problems faced by the establishment of a unified China ASEAN civil judicial assistance system.
The third part analyzes the mode selection of the unified China ASEAN civil judicial assistance system. After a comparative analysis of the three representative legislative modes of unified civil judicial assistance, it is considered that the gradual transition from bilateral agreements to the multilateral and unified civil judicial assistance convention is currently suitable for China East. The legislative model of the free trade zone of the league.
In the fourth part, under the framework of the transition from bilateral agreements to multilateral conventions, the specific contents of the civil judicial assistance system are constructed and perfected, namely, extraterritorial delivery, extraterritorial forensics, the recognition and enforcement of foreign courts' civil judgments and foreign arbitral awards, especially the judgment of foreign courts. In the system of the civil judicial assistance system of the league, in view of the difficulty in achieving a comprehensive Multilateral Convention on civil judicial assistance, it is possible to attempt to reach a special Convention for the various systems of civil judicial assistance.
The last part is a conclusion, and a summary of the full text is made. Some system design problems should be paid attention to in the course of the process.
