【摘要】：以代議制民主為基礎(chǔ)的歐盟,其“民主赤字”問題也首先表現(xiàn)為代議制民主的“議會(huì)民主赤字”(Parliamentary Deficit)。在以往的研究中,圍繞歐盟“民主赤字”問題的討論主要是圍繞歐洲議會(huì)展開的。隨著歐洲一體化進(jìn)程的深化以及對(duì)“民主赤字”問題的深入探討,歐洲學(xué)者們開始意識(shí)到歐盟的“議會(huì)民主赤字”不僅僅存在于歐洲議會(huì),另一個(gè)代議制機(jī)構(gòu)——成員國(guó)議會(huì),也存在“民主赤字”問題。這被認(rèn)為是歐盟的“雙重民主赤字"(Double democratic deficit),即在歐洲議會(huì)和成員國(guó)議會(huì)都存在著“民主赤字”。 本論文將著重對(duì)成員國(guó)議會(huì)的“民主赤字”問題進(jìn)行研究。這一問題表現(xiàn)在兩個(gè)層面。在歐盟層面,成員國(guó)議會(huì)在一體化進(jìn)程中上交的一部分權(quán)力被授予了歐盟委員會(huì)和理事會(huì),而不是歐洲議會(huì)；即使最近幾次的歐盟條約修訂賦予了歐洲議會(huì)更大的權(quán)力,但由于歐洲議會(huì)選舉的低投票率,歐洲議會(huì)自身的合法性也存在一定的疑問。因此,成員國(guó)議會(huì)應(yīng)該作為歐洲議會(huì)代議制民主的補(bǔ)充,更多地參與到歐盟層面的決策過程中。在國(guó)家層面,由于歐盟的超國(guó)家性,成員國(guó)議會(huì)也需要從傳統(tǒng)的國(guó)家議會(huì)向歐盟成員國(guó)的國(guó)家議會(huì)轉(zhuǎn)變,在國(guó)家層面的歐盟事務(wù)決策中發(fā)揮更大作用。但轉(zhuǎn)型中的成員國(guó)議會(huì)缺乏對(duì)國(guó)家層面歐盟事務(wù)的有效參與,因此在這一方面也存在“民主赤字”。 本文的引言部分將陳述選題緣由及對(duì)研究現(xiàn)狀進(jìn)行梳理。第一章以歷史的角度,回顧從煤鋼共同體建立初期到制憲會(huì)議前,成員國(guó)議會(huì)在一體化發(fā)展歷程中所扮演的角色,從而引出對(duì)于成員國(guó)議會(huì)“民主赤字”問題的思考。第二章就歐盟的“雙重民主赤字”,尤其是成員國(guó)議會(huì)的“民主赤字”問題進(jìn)行闡述,深入討論其兩個(gè)維度。第三章探討歐盟制憲進(jìn)程和《里斯本條約》對(duì)成員國(guó)議會(huì)作用的改革設(shè)想,分析改革后成員國(guó)議會(huì)在歐盟決策中的參與,以及歐盟解決成員國(guó)議會(huì)“民主赤字”的現(xiàn)有方案所面臨的困境和挑戰(zhàn)。
[Abstract]:On the basis of representative democracy, the European Union's "democratic deficit" is also the parliamentary deficit of representative democracy. In previous studies, the debate over the EU's democratic deficit has centred on the European Parliament. With the deepening of the process of European integration and the in-depth discussion of the issue of "democratic deficit", European scholars are beginning to realize that the "parliamentary democratic deficit" of the EU exists not only in the European Parliament, but also in the parliaments of member States, another representative body. There is also a "democratic deficit" problem. This is thought to be the "double democratic deficit)," of the European Union, where there is a "democratic deficit" in both the European Parliament and the member parliaments. This paper will focus on the issue of "democratic deficit" in member parliaments. The problem manifests itself on two levels. At the EU level, some of the powers handed over by member parliaments in the integration process have been delegated to the European Commission and the Council, rather than to the European Parliament; even though recent EU treaty amendments have given the European Parliament greater powers, But the European Parliament's own legitimacy is in doubt because of the low turnout in parliamentary elections. As a result, member parliaments should be more involved in EU-level decision-making as a complement to representative democracy in the European Parliament. At the national level, due to the supranational nature of the EU, member parliaments also need to change from the traditional national parliaments to the national parliaments of the EU member states and play a greater role in EU decision-making at the national level. But the transition member parliaments lack effective participation in EU affairs at the national level, so there are also "democratic deficits" in this area. The introduction of this paper will state the reasons for the topic and the status quo of the research. The first chapter reviews the role played by member parliaments in the process of integration development from the beginning of the coal and steel community to the Constituent Assembly, which leads to the consideration of the issue of "democratic deficit" in the parliaments of member States. The second chapter expounds the "double democratic deficit" of the EU, especially the "democratic deficit" of the member parliaments, and discusses its two dimensions in depth. The third chapter discusses the reform of the role of the member parliaments in the EU constitution-making process and the Lisbon Treaty, and analyzes the participation of the member parliaments in the EU decision-making after the reform. And the difficulties and challenges of the EU's existing solutions to the "democratic deficit" of member parliaments.
