【摘要】：自由貿(mào)易區(qū)憑借其靈活、快捷和深度合作的特性在經(jīng)濟一體化進程中得以快速發(fā)展，尤其是在多邊貿(mào)易談判步履維艱的情況下，自貿(mào)區(qū)是區(qū)域經(jīng)濟一體化的一種很好嘗試。隨著自貿(mào)區(qū)優(yōu)勢的凸顯，，越來越多的國家開始關(guān)注自貿(mào)區(qū)的建設(shè)，很多國家已經(jīng)將自貿(mào)區(qū)建設(shè)提升到國家發(fā)展戰(zhàn)略高度。我國自貿(mào)區(qū)發(fā)展起步較晚，“實施自貿(mào)區(qū)戰(zhàn)略”的表述直到中共十七大時才被提出。自貿(mào)區(qū)戰(zhàn)略的推進是一項綜合、復(fù)雜的工程，自貿(mào)協(xié)定作為自貿(mào)區(qū)法律基礎(chǔ)，決定著自貿(mào)區(qū)建設(shè)的整體水平，因此完善自貿(mào)協(xié)定對推進這項工程至關(guān)重要。 本文采用了法學分析、比較學方法以及政治學思維的研究方法對“FTA”用詞規(guī)范、我國自貿(mào)協(xié)定發(fā)展過程中的問題、自貿(mào)協(xié)定文本結(jié)構(gòu)模式如何完善等方面進行研究，對今后推進自由貿(mào)易區(qū)戰(zhàn)略建設(shè)的法律基礎(chǔ)如何進行完善提出建議。 本文主要由四部分構(gòu)成：第一部分主要是對自由貿(mào)易區(qū)概念的厘定、自貿(mào)區(qū)發(fā)展歷程以及對兩個“FTA”用詞規(guī)范進行探討。第二部分主要是對自貿(mào)協(xié)定的研究，包括自貿(mào)協(xié)定的文本模式、內(nèi)容結(jié)構(gòu)以及締結(jié)程序三個方面。第三部分主要是對我國目前已經(jīng)簽訂的自貿(mào)協(xié)定入手，分析當前我國自貿(mào)區(qū)建設(shè)中自貿(mào)協(xié)定存在的問題。第四部分則是針對我國自貿(mào)協(xié)定的問題提出相應(yīng)的完善建議。
[Abstract]:Free Trade area (FTA) develops rapidly in the process of economic integration by virtue of its characteristics of flexibility, rapidity and depth of cooperation, especially in the difficult situation of multilateral trade negotiations, free trade area is a good attempt of regional economic integration. With the prominence of the advantages of the free trade zone, more and more countries begin to pay attention to the construction of the free trade zone. Many countries have promoted the construction of the free trade zone to the height of national development strategy. The development of free trade zones in China started late, and the expression of "implementing the strategy of free trade zones" was not put forward until the 17th National Congress of the Communist Party of China. The promotion of free trade area strategy is a comprehensive and complex project. As the legal basis of free trade area, free trade agreement determines the overall level of free trade area construction, so it is very important to improve the free trade agreement. This paper uses the method of legal analysis, comparative study and political science thinking to study the terms of FTA, the problems in the process of development of FTA in China, and how to perfect the model of text structure of FTA, and so on. Some suggestions on how to improve the legal basis of the strategy construction of free trade area in the future are put forward. This paper is mainly composed of four parts: the first part is the definition of free trade area, the development of free trade area and the discussion of two "FTA" terminology norms. The second part mainly studies the FTA, including the text model, the content structure and the conclusion procedure of the FTA. The third part is to analyze the existing problems of free trade agreement in the construction of free trade zone in our country. The fourth part is to put forward the corresponding consummation suggestion to our country free trade agreement question.
