承運(yùn)人交貨義務(wù)與責(zé)任研究

【摘要】:作為海上貨物運(yùn)輸活動(dòng)中的重要參與者之一,承運(yùn)人在海上貨物運(yùn)輸中承擔(dān)著眾多的責(zé)任義務(wù),交貨義務(wù)便是上述義務(wù)之一。由于在貨物交付階段參與主體較多,各方利益比較集中,法律關(guān)系相對(duì)復(fù)雜,因此實(shí)踐中承運(yùn)人在履行交貨義務(wù)時(shí)往往面臨較大的風(fēng)險(xiǎn),稍有不慎,便會(huì)背負(fù)巨額賠償。本文以承運(yùn)人的交貨義務(wù)與責(zé)任為研究對(duì)象,立足于航運(yùn)實(shí)踐,借鑒國(guó)外的立法經(jīng)驗(yàn),旨在完善我國(guó)實(shí)踐中的相關(guān)做法,促進(jìn)貨物交付行為的順利進(jìn)行,為航運(yùn)事業(yè)的發(fā)展貢獻(xiàn)微薄之力。 本文共分為五章。 第一章貨物交付的基本理論。第一節(jié)在對(duì)民法中交付含義進(jìn)行分析的基礎(chǔ)之上,明確了海商法下貨物交付的概念。第二節(jié)通過(guò)對(duì)相關(guān)國(guó)際公約的比較分析,闡釋了海商法下貨物交付義務(wù)的法律依據(jù)。 第二章承運(yùn)人交貨義務(wù)的履行。第一節(jié)從定義、識(shí)別方法等方面對(duì)交貨的義務(wù)主體——承運(yùn)人進(jìn)行分析,同時(shí)對(duì)實(shí)際承運(yùn)人是否負(fù)有交貨義務(wù)進(jìn)行了詳細(xì)的闡述。第二節(jié)分析了收貨人的定義和不同情形下收貨人的識(shí)別方法,同時(shí)筆者對(duì)港口當(dāng)局不能成為收貨人進(jìn)行了分析。第三節(jié)從通知義務(wù)的履行、按約定的時(shí)間地點(diǎn)交貨、憑正本提單交貨、按單證記載交貨四個(gè)方面詳細(xì)論述了承運(yùn)人履行交貨義務(wù)的具體要求。 第三章承運(yùn)人違反交貨義務(wù)的責(zé)任承擔(dān)。第一節(jié)對(duì)承運(yùn)人遲延交付時(shí)的責(zé)任承擔(dān)進(jìn)行具體分析,分別列舉了遲延交付時(shí)物質(zhì)損失和經(jīng)濟(jì)損失的賠償范圍以及計(jì)算方法等,并且對(duì)承運(yùn)人遲延交付的抗辯進(jìn)行了列舉。第二節(jié)是對(duì)承運(yùn)人無(wú)單放貨時(shí)的責(zé)任承擔(dān)進(jìn)行的分析。其中主要是對(duì)無(wú)單放貨時(shí)其他直接經(jīng)濟(jì)損失賠償問(wèn)題的分析。 第四章承運(yùn)人交貨受阻時(shí)的權(quán)利救濟(jì)困境及完善建議。第一節(jié)對(duì)交貨受阻的定義進(jìn)行界定。第二節(jié)具體闡述了承運(yùn)人在交貨受阻時(shí)行使法律賦予的救濟(jì)權(quán)利時(shí)所遇到的困境。第三節(jié)列舉了《鹿特丹規(guī)則》關(guān)于承運(yùn)人交貨受阻時(shí)的救濟(jì)方法的相關(guān)規(guī)定。第四節(jié)對(duì)完善我國(guó)承運(yùn)人交貨受阻時(shí)的救濟(jì)權(quán)利提出建議。 第五章結(jié)論。關(guān)于完善《海商法》中承運(yùn)人交貨義務(wù)與責(zé)任的建議。分別從完善對(duì)遲延交付的規(guī)定、提高責(zé)任限額和交貨受阻時(shí)承運(yùn)人的救濟(jì)權(quán)利方面提出建議。
[Abstract]:As one of the important participants in the carriage of goods by sea, the carrier bears many obligations of responsibility in the carriage of goods by sea, and the obligation to deliver goods is one of these obligations. Because there are more participants in the stage of delivery of goods, the interests of all parties are more concentrated, and the legal relationship is relatively complex, in practice, the carrier often faces greater risks in performing the obligation of delivery, and if he is a little careless, he will bear a huge amount of compensation. This article takes the carrier's delivery duty and liability as the research object, bases on the shipping practice, draws lessons from the foreign legislation experience, in order to consummate the related practice in our country, promotes the goods delivery behavior smoothly. Contribute to the development of shipping industry. This paper is divided into five chapters. The first chapter is the basic theory of the delivery of goods. The first section clarifies the concept of goods delivery under maritime law on the basis of analyzing the meaning of delivery in civil law. The second section explains the legal basis of the obligation of delivery of goods under maritime law through comparative analysis of relevant international conventions. Chapter II performance of the carrier's obligation to deliver goods. In the first section, the carrier is analyzed in terms of definition and identification method, and whether the actual carrier has the obligation to deliver the goods is elaborated in detail. The second section analyzes the definition of consignee and the identification method of consignee under different circumstances. At the same time, the author analyzes that the port authority can not be the consignee. The third section discusses in detail the specific requirements of the carrier to perform the obligation of delivery from four aspects: the performance of the obligation of notification, the delivery of the goods at the agreed time and place, the delivery of the original bill of lading, and the delivery of goods recorded in the documents. Chapter III the carrier is liable for breach of the obligation of delivery. In the first section, the author makes a concrete analysis of the carrier's liability for late delivery, enumerates the compensation scope of material loss and economic loss and the calculation method respectively, and enumerates the defense of carrier's delay in delivery. The second section is the analysis of the carrier's liability. It mainly analyzes the compensation of other direct economic losses when the goods are released without bill. The fourth chapter is about the remedy dilemma of the carrier's right when the delivery of goods is obstructed and the suggestions to improve it. The first section defines the obstruction of delivery. The second section elaborates the difficulties encountered by the carrier in exercising the relief rights granted by law when the delivery of goods is obstructed. Section III enumerates the Rotterdam rules on the carrier's remedies in case of obstruction of delivery. The fourth section puts forward some suggestions to improve the relief right of the carrier when the delivery of goods in our country is blocked. Chapter V conclusion. Suggestions on perfecting the carrier's obligation and liability to deliver goods in Maritime Law. Suggestions are made on improving the provisions on delay in delivery, raising the limitation of liability and the carrier's right to remedy if delivery is obstructed.
