【摘要】:中國是共同開發(fā)的積極倡導(dǎo)者,愿意以共同開發(fā)方式解決與周邊國家的海洋劃界和領(lǐng)土爭端。我國目前所采取的策略是堅持雙邊談判,主要考慮在僅僅涉及兩個國家的爭議區(qū)域建立雙邊性的共同開發(fā)制度。中國提出的“擱置爭議,共同開發(fā)”的主張,是目前處理海洋資源爭議最現(xiàn)實可行的方法。 全文除緒論與總結(jié)外,共分五個部分: 第一部分,共同開發(fā)海洋資源的法律制度概述,最先寫出共同開發(fā)海洋資源的含義和歷史沿革,包括共同開發(fā)海洋資源的含義,共同開發(fā)海洋資源的歷史沿革。接著寫共同開發(fā)海洋資源的法律依據(jù)和法律原則。最后寫共同開發(fā)海洋資源的法律特征和法律地位,從法理角度進(jìn)行闡述。 第二部分,共同開發(fā)海洋資源的國家實踐與評析,首先介紹共同開發(fā)海洋資源的兩種類型;跨界海洋礦藏的共同開發(fā)和重疊海域資源的共同開發(fā)。接著舉兩個例子加以說明,對兩個條約的核心內(nèi)容加以闡述,并對它們進(jìn)行評析。 第三部分,共同開發(fā)區(qū)的相關(guān)法律制度,首先寫共同開發(fā)區(qū)的行政管理模式和管理機構(gòu),接著完整闡述共同開發(fā)區(qū)的稅收法律制度,最后寫共同開發(fā)區(qū)的收益分配制度。 第四部分,共同開發(fā)區(qū)的管轄權(quán)與爭端解決機制,首先寫共同開發(fā)區(qū)法律框架,接著寫共同開發(fā)區(qū)的管轄權(quán)的分配,最后寫共同開發(fā)區(qū)爭端的解決。 第五部分,中國與海洋資源共同開發(fā),最先寫中國實行共同開發(fā)的必要性和可行性,從三個方面進(jìn)行闡述,接著分別寫中國東海和中國南海與共同開發(fā),并對方案進(jìn)行評析。
[Abstract]:China is an active advocate of joint development and is willing to resolve maritime delimitation and territorial disputes with neighboring countries through joint development. The strategy adopted by our country at present is to insist on bilateral negotiations and mainly consider the establishment of a bilateral joint development system in the disputed areas involving only two countries. China's idea of "shelving disputes and developing jointly" is the most practical and feasible way to deal with disputes over marine resources. In addition to the introduction and summary, the full text is divided into five parts: the first part is an overview of the legal system for the joint development of marine resources, the first to write out the meaning and historical evolution of the joint development of marine resources. Including the meaning of joint development of marine resources, the historical evolution of joint development of marine resources. Then write the legal basis and principles of joint development of marine resources. Finally, the legal characteristics and legal status of joint development of marine resources are described from the perspective of legal theory. In the second part, the national practice and evaluation of joint exploitation of marine resources are introduced. Firstly, two types of joint exploitation of marine resources, joint exploitation of transboundary marine deposits and joint exploitation of overlapping marine resources are introduced. Then two examples are given to illustrate the core contents of the two treaties and to comment on them. The third part, the related legal system of the joint development zone, firstly, the administrative management model and the management organization of the joint development zone, then the tax law system of the joint development zone, and finally the income distribution system of the joint development zone. The fourth part, the jurisdiction and dispute settlement mechanism of the joint development zone, firstly, the legal framework of the joint development zone, then the distribution of the jurisdiction of the joint development zone, and finally the settlement of the joint development zone dispute. In the fifth part, China and marine resources are jointly exploited. The necessity and feasibility of China's joint development are first described, and then the East China Sea and South China Sea are described and the scheme is evaluated.
