【摘要】:20世紀(jì)以來,人類對(duì)油類的需求量日益增加,這促進(jìn)了海洋油類開采與船舶油類運(yùn)輸?shù)认嚓P(guān)行業(yè)的勃興。然而,在船舶油類運(yùn)輸過程中,溢油事故不時(shí)發(fā)生,導(dǎo)致了一系列的損失,這些損失包括直接財(cái)產(chǎn)損失、寄生性損失、關(guān)聯(lián)性經(jīng)濟(jì)損失以及海洋環(huán)境經(jīng)濟(jì)損失,其中關(guān)聯(lián)性經(jīng)濟(jì)損失與海洋環(huán)境經(jīng)濟(jì)損失就是本文所要探討的船舶油污染純粹經(jīng)濟(jì)損失。是否應(yīng)該對(duì)船舶油污染純粹經(jīng)濟(jì)損失給予賠償以及賠償?shù)姆秶蜆?biāo)準(zhǔn)一直是相關(guān)國(guó)際公約及各國(guó)國(guó)內(nèi)立法爭(zhēng)議的焦點(diǎn),對(duì)船舶油污染純粹經(jīng)濟(jì)損失賠償進(jìn)行研究,具有重要的理論和現(xiàn)實(shí)意義。本文主要運(yùn)用比較、實(shí)證分析和法經(jīng)濟(jì)學(xué)等研究方法,對(duì)國(guó)際公約、民間協(xié)定、典型代表國(guó)家與我國(guó)關(guān)于船舶油污染純粹經(jīng)濟(jì)損失賠償?shù)南嚓P(guān)立法與實(shí)踐進(jìn)行比較分析,對(duì)船舶油污染純粹經(jīng)濟(jì)損失賠償?shù)幕纠碚、?zé)任關(guān)系主體、責(zé)任認(rèn)定、賠償范圍予以闡述,從理論和實(shí)證兩個(gè)方面對(duì)船舶油污染純粹經(jīng)濟(jì)損失賠償問題進(jìn)行研究,在此基礎(chǔ)上,針對(duì)我國(guó)立法及司法實(shí)踐的不足,提出完善我國(guó)船舶油污染純粹經(jīng)濟(jì)損失賠償?shù)慕ㄗh。本文除前言和結(jié)論部分外,共分五章。第一章主要通過分析船舶、船舶油污染、船舶油污染純粹經(jīng)濟(jì)損失的概念、特征及其賠償立法的發(fā)展歷史、政策考量因素、基本原則來闡述船舶油污染純粹經(jīng)濟(jì)損失賠償?shù)幕纠碚。第二章從索賠主體與賠償主體兩方面對(duì)船舶油污染純粹經(jīng)濟(jì)損失賠償關(guān)系主體予以闡述。第三章在分析侵權(quán)法對(duì)于環(huán)境侵權(quán)責(zé)任的構(gòu)成要件、歸責(zé)原則、因果關(guān)系以及舉證責(zé)任規(guī)定的基礎(chǔ)上,闡述了認(rèn)定船舶油污染純粹經(jīng)濟(jì)損失賠償責(zé)任應(yīng)該適用的歸責(zé)原則及舉證責(zé)任,論證了判定因果關(guān)系的規(guī)則。第四章通過比較國(guó)際公約與各國(guó)國(guó)內(nèi)法對(duì)賠償范圍和賠償標(biāo)準(zhǔn)的不同規(guī)定,運(yùn)用法經(jīng)濟(jì)學(xué)的研究方法,對(duì)船舶油污染純粹經(jīng)濟(jì)損失的賠償范圍和賠償標(biāo)準(zhǔn)進(jìn)行了闡述。第五章針對(duì)我國(guó)立法與司法實(shí)踐存在的諸多不足,借鑒國(guó)際公約、國(guó)外典型國(guó)家的立法及司法實(shí)踐,從賠償關(guān)系主體制度、賠償責(zé)任的認(rèn)定、賠償范圍的確定及賠償標(biāo)準(zhǔn)的適用等方面提出了完善我國(guó)船舶油污染純粹經(jīng)濟(jì)損失賠償?shù)慕ㄗh。
[Abstract]:Since the 20th century, the demand for oil has been increasing day by day, which promotes the development of marine oil production and shipping oil transportation and other related industries. However, oil spills occur from time to time in the course of shipping oil transportation, resulting in a series of losses, including direct property losses, parasitic losses, associated economic losses and economic losses of the marine environment. The related economic loss and the economic loss of marine environment are the pure economic losses of marine oil pollution discussed in this paper. The scope and standard of compensation for pure economic losses caused by oil pollution from ships has always been the focus of controversy in relevant international conventions and domestic legislation. The compensation for pure economic losses caused by oil pollution from ships has been studied. It has important theoretical and practical significance. This article mainly uses the comparison, the demonstration analysis and the law economics and so on research method, carries on the comparative analysis to the international convention, the folk agreement, the typical representative country and our country regarding the ship oil pollution pure economic loss compensation related legislation and the practice carries on the comparative analysis. The basic theory of compensation for pure economic losses caused by oil pollution from ships, the main body of liability, the determination of liability and the scope of compensation are expounded, and the problem of compensation for pure economic losses caused by oil pollution of ships is studied theoretically and empirically. On this basis, in view of the insufficiency of legislation and judicial practice in our country, some suggestions are put forward to perfect the compensation for pure economic loss caused by oil pollution of ships in our country. In addition to the preface and conclusion, this paper is divided into five chapters. The first chapter mainly analyzes the concept of pure economic loss of ship and ship oil pollution, its characteristics and the development history of compensation legislation, policy considerations. The basic principle is to expound the basic theory of compensation for pure economic loss caused by ship oil pollution. The second chapter expounds the main body of compensation for pure economic loss of ship oil pollution from two aspects: the main body of claim and the main body of compensation. The third chapter is based on the analysis of the constitution of tort law for environmental tort liability, the principle of imputation, the causality and the provision of burden of proof. This paper expounds the principle of imputation and the burden of proof which should be applied in determining the liability for compensation for pure economic losses caused by ship oil pollution, and proves the rules of determining causality. In the fourth chapter, by comparing the different provisions of international conventions and national laws on the scope and standard of compensation, the scope and standard of compensation for pure economic losses caused by oil pollution from ships are expounded by means of the research methods of law and economics. The fifth chapter aims at the deficiency of our country's legislation and judicial practice, draws lessons from the international convention, the legislation and judicial practice of the typical foreign country, from the compensation relation subject system, the cognizance of the compensation liability. Some suggestions are put forward to perfect the compensation for pure economic loss caused by oil pollution of ships in China from the aspects of the determination of compensation scope and the application of compensation standard.
