【摘要】：為了進(jìn)一步建設(shè)和完善越南經(jīng)濟(jì)法律體系,符合國際法律規(guī)范,并為越南融入國際提供良好條件,限制傾銷出口商品對國內(nèi)商品帶來的消極影響,2004年越南已經(jīng)頒布了《越南對進(jìn)口商品反傾銷法令》。但,該法令只是不完整地重復(fù)WTO反傾銷協(xié)議(簡稱ADA)的各項(xiàng)規(guī)定,所以該法令的內(nèi)容相當(dāng)簡單。自從生效之后,由于許多原因該法律文件從未運(yùn)用到實(shí)踐。本論文第一部分主要介紹和分析傾銷、反傾銷概念、越南反傾銷法發(fā)展過程及其對市場發(fā)展的影響。反傾銷法令就是國家保護(hù)國內(nèi)貨物的手段,但,在特殊的情況下,反傾銷法可以對社會(huì)利益帶來很大的損害。第二部分主要分析越南反傾銷法令的正常價(jià)值、出口價(jià)、國內(nèi)產(chǎn)業(yè)、國內(nèi)產(chǎn)業(yè)損害、損害威脅等概念,從而確定傾銷現(xiàn)象。通過第二部分的內(nèi)容,第三部分主要分析關(guān)于反傾銷案件的調(diào)查程序、處理程序、采取反傾銷措施以及越南反傾銷法的實(shí)施機(jī)制。分析第二部分和第三部分之時(shí),筆者都指出《越南對進(jìn)口商品反傾銷法令》的各項(xiàng)規(guī)定都存在限制,并將其與WTO、加拿大、美國等國法律的規(guī)定進(jìn)行比較。第四部分,主要通過分析《越南對進(jìn)口商品反傾銷法令》的缺陷,從而提出完善的措施
[Abstract]:In order to further build and improve the Vietnamese economic and legal system, comply with international legal norms, and provide good conditions for Vietnam's integration into the international community, In 2004, Viet Nam issued the Anti-dumping Law on imported goods. However, the Act merely repeats the provisions of the WTO Anti-dumping Agreement (ADAA) in an incomplete manner, so the content of the Act is quite simple. Since its entry into force, the legal document has never been applied in practice for many reasons. The first part of this paper mainly introduces and analyzes dumping, the concept of anti-dumping, the development process of Vietnam's anti-dumping law and its influence on market development. Anti-dumping law is a means to protect domestic goods, but in special circumstances, anti-dumping law can bring great harm to social interests. The second part mainly analyzes the normal value, export price, domestic industrial injury, injury threat and other concepts of Vietnam antidumping law, so as to determine dumping phenomenon. Through the content of the second part, the third part mainly analyzes the investigation procedure, the handling procedure, the antidumping measures and the enforcement mechanism of Vietnam antidumping law. When analyzing the second part and the third part, the author points out that the provisions of Vietnam Anti-dumping Act on imports are restricted, and compares them with those of WTO, Canada, the United States and other countries. The fourth part, mainly through the analysis of the defects of "Vietnam Anti-dumping Law on imports", and then put forward the perfect measures.
