【摘要】：近年來(lái),在一些國(guó)際領(lǐng)域包括WTO爭(zhēng)端解決機(jī)制,“法庭之友”介入訴訟的案件不但數(shù)量日益增加,而且影響愈加擴(kuò)大�！胺ㄍブ选币辉~起源于羅馬法,早期由英國(guó)法官在法院的審判實(shí)踐中將其引入英國(guó),后來(lái)被移植于美國(guó)并得到了很大的發(fā)展。設(shè)置該制度的目的和價(jià)值在于“法庭之友”能夠?yàn)榉ㄔ禾峁┥形凑莆盏陌讣聦?shí)或法律意見(jiàn),以便使法官做出公正合理的裁決,并且這一制度體現(xiàn)了司法審判活動(dòng)中的民主精神,更有利于增加司法權(quán)威和增強(qiáng)公眾信任。 本文前部分在分析各國(guó)法庭之友概念的基礎(chǔ)上,歸納出相關(guān)要素,最后定義其概念。從“法庭之友”在WTO爭(zhēng)端解決機(jī)制的實(shí)踐來(lái)看,對(duì)加入WTO已有十年之久的中國(guó)來(lái)說(shuō),具有重大的現(xiàn)實(shí)意義。本文通過(guò)對(duì)“法庭之友”在英美法系國(guó)家和WTO爭(zhēng)端解決機(jī)制中的發(fā)展歷程及特點(diǎn)分析,提出我國(guó)應(yīng)采取的具體措施,指導(dǎo)我國(guó)在WTO爭(zhēng)端解決機(jī)制的實(shí)踐中做出更有利于自己的行動(dòng)。最后本文對(duì)WTO爭(zhēng)端解決機(jī)制中引入“法庭之友”的合法性進(jìn)行評(píng)價(jià)以及我國(guó)對(duì)待WTO爭(zhēng)端解決機(jī)制中“法庭之友”的態(tài)度。
[Abstract]:In recent years, in some international fields, including the WTO dispute settlement mechanism, "amicus curiae" cases involved in litigation not only increase in number, but also expand the impact. The term "amicus curiae" originated in Roman law and was introduced into England by English judges in court practice in the early years. It was transplanted to the United States and developed greatly. The purpose and value of the system is that the amicus curiae is able to provide the Court with factual or legal opinions on cases that are not yet available to the Court in order to enable the judges to make fair and reasonable decisions, And this system reflects the democratic spirit in judicial activities, which is more conducive to increasing judicial authority and public trust. On the basis of analyzing the concept of amicus curiae in various countries, the first part of this paper induces the relevant elements, and finally defines the concept of amicus curiae. From the practice of amicus curiae in the dispute settlement mechanism of WTO, it is of great practical significance to China, which has been a member of WTO for ten years. Based on the analysis of the development and characteristics of amicus curiae in Anglo-American law countries and WTO dispute settlement mechanism, this paper puts forward some concrete measures to be taken in China. To guide our country in the practice of WTO dispute settlement mechanism to do more in favor of their own actions. Finally, this paper evaluates the legality of the introduction of amicus curiae into the WTO dispute settlement mechanism and the attitude of our country towards the amicus curiae in the WTO dispute settlement mechanism.
