海上貨物運輸中合同自由的適用與嬗變

【摘要】:民法中的合同自由起源于羅馬法的萬民法,自《法國民法典》提出,《德國民法典》將其確立為基本原則。以三大海上貨物運輸公約為點,英國的社會發(fā)展為線,全球經(jīng)濟一體化為面,來考察海上貨物運輸領(lǐng)域的合同自由,我們會發(fā)現(xiàn)其經(jīng)歷一個反復近似螺旋上升的發(fā)展歷程。該歷程經(jīng)歷了一個海上冒險中的自然存在、限制、放開到再限制,最后又回歸適度放開。螺旋發(fā)展的中軸是市場模式以及市場主體地位。重新認識到自由貿(mào)易重要性的今天,對市場主體不平等的調(diào)節(jié)應(yīng)該交給反壟斷法或反不正當競爭法去調(diào)整,而不是海上貨物運輸法。
[Abstract]:The freedom of contract in the civil law originated from the laws of the peoples of Roman law. Since the French Civil Code was put forward, the German Civil Code established it as the basic principle. Taking the three conventions on the carriage of goods on the sea as the point, the social development of Britain as the line, and the integration of the global economy as the face, we can find that the contract freedom in the field of carriage of goods by sea has experienced a development process which has experienced a repeated and similar spiral rise. The course goes through the natural existence of a marine adventure, the limitation, the release to the limit, and finally the return to moderate liberalization. The central axis of spiral development is the market model and market main position. Today, when the importance of free trade is recognized again, the adjustment of market main body inequality should be transferred to anti-monopoly law or anti-unfair competition law, not the law of carriage of goods by sea.
