【摘要】：金磚銀行享有司法豁免權(quán)并不排斥對第三方權(quán)益的保障。國際組織爭端解決實(shí)踐表明,為第三方提供適當(dāng)?shù)木葷?jì)路徑有助于金磚銀行司法豁免權(quán)獲得非成員國的承認(rèn),從而降低涉訴風(fēng)險(xiǎn)。在現(xiàn)行國際法體制下,金磚銀行對第三方承擔(dān)的不是實(shí)體性的人權(quán)保護(hù)義務(wù),而是程序性的救濟(jì)路徑保障。為此,我國可以推動金磚銀行借鑒多邊開發(fā)銀行經(jīng)驗(yàn),建立監(jiān)察機(jī)制,并明確我國法院對金磚銀行的司法管轄和豁免標(biāo)準(zhǔn)。
[Abstract]:BRICS's immunity from justice does not preclude the protection of third-party rights. International organization dispute settlement practice has shown that providing an appropriate remedy path for third parties can help BRICS to obtain recognition of non-member countries' immunity and thus reduce the risk of litigation. Under the current international law system, the BRICS bank is not the substantive obligation to protect human rights to third parties, but procedural relief path guarantee. Therefore, China can promote the BRICS bank to draw lessons from the experience of the multilateral development banks, establish a supervisory mechanism, and clarify the jurisdiction and immunity standards of the BRICS bank.
