【摘要】：摘要：隨著國際服務貿(mào)易的快速發(fā)展,國際服務貿(mào)易的自由化已是大勢所趨,但服務貿(mào)易自由化也是一柄雙刃劍,它在給有關國家?guī)砝娴耐瑫r,也可能會給這些國家?guī)韲乐貫碾y,在這一過程中,各成員方既要獲得服務貿(mào)易自由化所帶來的利益,又要規(guī)避服務貿(mào)易自由化所帶來的風險。要達成這樣的目標,最根本的途徑就是要建立一套保障措施機制。 本文第一章主要介紹了緊急保障措施的概況,包括國際服務貿(mào)易的基本問題,GATS緊急保障措施規(guī)則產(chǎn)生的背景和過程以及緊急保障措施的談判進程并就談判中成員方對在多邊體制下建立服務貿(mào)易緊急保障措施制度的必要性和可行性分歧進行闡述,確定了在GATS框架下中建立服務貿(mào)易緊急保障措施制度的必要性。第二章介紹了有關服務貿(mào)易緊急保障措施的區(qū)域性貿(mào)易協(xié)定,并對各協(xié)定的具體內(nèi)容進行了分析和總結(jié)。第三章就在GATS中建立服務貿(mào)易緊急保障措施制度多應選擇的模式提出了具體建議。第四章就緊急保障措施制度內(nèi)容提出了大膽設想并總結(jié)了緊急保障措施對我國的現(xiàn)實意義。 選擇本題的意義在于論證了中國作為世界上最大的發(fā)展中國家在GATS規(guī)則談判中應堅持的立場：在國際服務貿(mào)易緊急保障措施制度的構建中維護發(fā)展中國家的利益,積極支持ESM制度的建立。同時對于ESM制度的構建模式和具體內(nèi)容進行設計。
[Abstract]:Absrtact: with the rapid development of international service trade, the liberalization of international service trade has been the trend of the times, but the liberalization of trade in services is also a double-edged sword, which brings benefits to the countries concerned at the same time. It may also bring serious disaster to these countries. In this process, members should not only obtain the benefits of the liberalization of trade in services, but also avoid the risks brought about by the liberalization of trade in services. The most fundamental way to achieve this goal is to establish a safeguards mechanism. The first chapter of this paper mainly introduces the general situation of emergency safeguard measures. Including the basic issues of international trade in services, the background and process of the emergence of the GATS emergency safeguard measures rules and the negotiation process of emergency safeguards and the establishment of emergency safeguard measures for trade in services under the multilateral system by the members in the negotiations. The necessity and feasibility of the system are discussed. The necessity of establishing an emergency safeguard system for trade in services under the framework of GATS is determined. The second chapter introduces the regional trade agreements on emergency safeguard measures for trade in services, and analyzes and summarizes the specific contents of the agreements. The third chapter puts forward some specific suggestions on how to establish the system of emergency safeguard measures in service trade in GATS. In chapter four, the author puts forward some bold ideas on the contents of emergency safeguard measures and summarizes the realistic significance of emergency safeguard measures to our country. The significance of choosing this question lies in demonstrating the position that China, as the largest developing country in the world, should adhere to in the negotiation of GATS rules: to safeguard the interests of developing countries in the construction of an emergency safeguard system for international trade in services. Actively support the establishment of ESM system. At the same time, the construction model and specific content of ESM system are designed.
