【摘要】:危險廢物越境非法運輸?shù)姆韶熑纬袚菄H社會長久以來關注的熱點之一,以《控制危險廢物及其轉移的巴塞爾公約》生效為標志,危險廢物非法運輸?shù)姆韶熑纬袚呀?jīng)從學者的理論變?yōu)榫哂屑s束力的國際公約。我們可以認為,一個規(guī)制危險廢物運輸和處置問題的法律體系已經(jīng)初步形成(以下稱“巴塞爾體系”)。 從世界上很多國家的實踐來看,隨著各種國際性、區(qū)域性公約以及雙邊協(xié)定的不斷締結,明顯的險廢物越境非法運輸已經(jīng)逐漸減少,而且其絕對數(shù)量也有下降,但是并沒有杜絕。巴塞爾體系關于民事責任問題的《巴塞爾公約責任和賠償議定書》并沒有生效,很多情況下,都是國家為危險廢物越境非法轉移埋單。 本文從《控制危險廢物及其轉移的巴塞爾公約》的歷史發(fā)展,內(nèi)容規(guī)定闡釋了巴塞爾體系下締約國的國家責任,又從理論上分析了未生效的議定書在危險廢物越境非法運輸民事責任的規(guī)定,最后論及我國履行該公約的現(xiàn)狀和我國關于危險廢物的基本法律規(guī)定及責任承擔。 關注該問題的目的有三點,一是對危險廢物方面的概念、涉及的條約以及巴塞爾體系的建立過程有全面的認識;二是深入了解巴塞爾體系下國家責任和民事責任的構成和規(guī)則,這是我國參與危險廢物游戲規(guī)則制定的重要路徑之一;三是通過對我國危險廢物越境非法運輸方面立法、實踐的分析,,希求推動我國這方面制度的發(fā)展和完善。
[Abstract]:The legal liability of illegal transboundary traffic of hazardous wastes is one of the hot spots in the international community for a long time, marked by the entry into force of the Basel Convention on the Control of Hazardous wastes and their movements. The legal liability for illegal traffic of hazardous wastes has changed from a scholar's theory to a binding international convention. We can think that a legal system to regulate the transport and disposal of hazardous wastes has been initially formed (hereinafter referred to as the Basel system). According to the practice of many countries in the world, with the conclusion of various international, regional conventions and bilateral agreements, the illegal transboundary traffic of hazardous wastes has gradually decreased, and its absolute number has also decreased. But it has not been eliminated. The Protocol on liability and compensation to the Basel Convention on Civil liability of the Basel system has not entered into force. In many cases, it is the State that pays for the illegal transboundary movement of hazardous wastes. From the historical development of the Basel Convention on the Control of Hazardous wastes and their transfer, this paper provides an explanation of the State responsibility of States parties under the Basel system. The article also theoretically analyzes the provisions of civil liability for the illegal traffic of hazardous waste across the border by the non-effective protocol, and finally discusses the present situation of the implementation of the Convention in China and the basic legal provisions and liability of our country on hazardous waste. The purpose of this concern is threefold, one is to have a comprehensive understanding of the concept of hazardous wastes, the treaties involved and the process of establishing the Basel system, and the other is to have an in-depth understanding of the composition and rules of State responsibility and civil liability under the Basel system, This is one of the important ways for our country to participate in the making of the rules of the hazardous waste game. Thirdly, through the analysis of the legislation and practice of illegal transboundary traffic of hazardous wastes in our country, we hope to promote the development and perfection of our country's system in this respect.
