【摘要】：對《補貼與反補貼措施協(xié)議》第1.1條(a)(1)(iii)中"一般基礎(chǔ)設(shè)施"的判斷,可借助公共物品理論對基礎(chǔ)設(shè)施進行類型化識R%。具體而言,純公共基礎(chǔ)設(shè)施自動構(gòu)成"一般基礎(chǔ)設(shè)施",除非政府行為限制此類基礎(chǔ)設(shè)施的使用;私人基礎(chǔ)設(shè)施自動喪失"一般基礎(chǔ)設(shè)施"的資格;準公共基礎(chǔ)設(shè)施應(yīng)首先被假定構(gòu)成"一般基礎(chǔ)設(shè)施",除非證據(jù)表明存在準入限制。準公共基礎(chǔ)設(shè)施應(yīng)進一步區(qū)別"俱樂部基礎(chǔ)設(shè)施"和"公共池塘基礎(chǔ)設(shè)施",并在符合比例性原則和普遍使用標準時構(gòu)成"一般基礎(chǔ)設(shè)施"。中國應(yīng)對美國相關(guān)反補貼調(diào)查的基本思路,應(yīng)是主張土地使用權(quán)和電力均構(gòu)成"公共池塘基礎(chǔ)設(shè)施",并分別根據(jù)普遍使用標準和比例性原則予以抗辯。
[Abstract]:To judge the "general infrastructure" in Article 1.1 of the Agreement on subsidies and countervailing measures, we can use the theory of public goods to type the infrastructure. In particular, pure public infrastructure automatically constitutes "general infrastructure" unless the use of such infrastructure is restricted by government action; private infrastructure automatically disqualifies from "general infrastructure"; Quasi-public infrastructure should first be assumed to constitute "general infrastructure" unless there is evidence of access restrictions. Quasi public infrastructure should further distinguish between "club infrastructure" and "public pond infrastructure" and constitute "general infrastructure" when it meets the principle of proportionality and universal standards of use. The basic idea of China's countervailing investigation in the United States should be to claim that land use right and electricity both constitute "public pond infrastructure", and to defend them respectively according to the universal use criteria and the principle of proportionality.
