【摘要】：海盜這一全人類的公敵((Hostis Humani Generis),自其肇始,便給國際社會帶來極大威脅,對國際法律秩序造成震動。海盜現(xiàn)象產(chǎn)生的最重要原因在于一些沿海落后國家的民眾衣食堪憂、生活完全沒有保障、貧富差距極端化。為了生存,民眾被迫鋌而走險從事海盜活動。 當前,一方面海盜活動正呈現(xiàn)出產(chǎn)業(yè)化、網(wǎng)絡化以及現(xiàn)代化等新的特點和發(fā)展趨勢,給國際合作懲治海盜帶來了嚴峻挑戰(zhàn)；另一方面,通過研究懲治海盜國際合作的現(xiàn)狀,可以發(fā)現(xiàn)懲治海盜的國際合作存在著以下制度性缺陷：第一,立法方面上看,國際社會不存在專門針對海盜犯罪的國際公約,已有的國際條約則存在著缺乏明確性、協(xié)調(diào)性等問題；第二,司法方面上來說,國際上沒有建立專門的審理捕獲海盜的法庭；第三,在懲治海盜合作機制運作方面尚未建立起普遍性的、有主導力量的強有力的國際合作機制等等。 因此,國際社會的當務之急是盡快完善懲治海盜國際合作的法律機制。就具體策略來說,一是構(gòu)建一部專門用來懲治海盜犯罪的國際公約；二是建立專門審理捕獲海盜的特別法庭并擴大國際刑事法院的管轄范圍,以便將海盜犯罪納入應受懲治的國際罪行行列；三是建立以聯(lián)合國安理會為主導的懲治海盜合作機制。
[Abstract]:Since its inception, piracy, the public enemy of all mankind, has posed a great threat to the international community and shaken the international legal order. The most important reason for piracy is that people in some backward coastal countries are worried about food and clothing, life is completely insecure, and the gap between the rich and the poor is extreme. In order to survive, people are forced to take the risk of piracy. At present, on the one hand, piracy activities are showing new characteristics and development trends such as industrialization, networking and modernization, which have brought serious challenges to international cooperation in punishing pirates; on the other hand, by studying the current situation of international cooperation in punishing pirates, It can be found that the international cooperation against piracy has the following institutional shortcomings: first, in terms of legislation, the international community does not have an international convention specifically aimed at piracy crimes, while the existing international treaties lack clarity. Issues such as coordination; secondly, the absence of a specialized international tribunal for the apprehension of pirates at the judicial level; and, third, the lack of universality in the operation of a cooperative mechanism for combating piracy, Powerful international cooperation mechanism with leading force and so on. Therefore, the urgent task of the international community is to improve the legal mechanism of international cooperation against piracy as soon as possible. As far as specific strategies are concerned, one is to establish an international convention dedicated to the punishment of piracy crimes, the other is to establish a special tribunal dedicated to the arrest of pirates and to expand the jurisdiction of the International Criminal Court. The third is to establish the cooperation mechanism of the UN Security Council.
