【摘要】：從目前世界經(jīng)濟(jì)發(fā)展的態(tài)勢(shì)來看,在未來的很長(zhǎng)一段時(shí)間內(nèi),能源供給問題都將會(huì)是左右經(jīng)濟(jì)發(fā)展水平和速度的最重要因素。作為石油、天然氣之外的一種高效、綠色能源,電力不但具有清潔、安全的特性,而且也是目前適用范圍最廣、適用性最強(qiáng)的一種能源。然而,電力資源也和石油、天然氣一樣,在區(qū)域分布上具有不均衡性。在世界范圍內(nèi),有些地區(qū)電力資源豐富,但電力資源需求量低,而有的地區(qū)電力資源比較匱乏,但電力資源的需求量卻很大,我國(guó)的電力資源分布就屬于這種類型,單純依靠我國(guó)國(guó)內(nèi)電力市場(chǎng)對(duì)電力資源進(jìn)行配置還不足以解決問題,還需要充分利用國(guó)際市場(chǎng)在資源配置方面的作用,提高電力資源的利用效率。電網(wǎng)企業(yè)的跨國(guó)經(jīng)營(yíng)活動(dòng)就是電網(wǎng)企業(yè)響應(yīng)國(guó)家“走出去”戰(zhàn)略的號(hào)召,利用國(guó)際市場(chǎng)配置區(qū)域電力資源的一種全新嘗試。 然而,與歐盟統(tǒng)一電網(wǎng)等成功范例相比,我國(guó)電網(wǎng)企業(yè)跨國(guó)經(jīng)營(yíng)活動(dòng)還有很長(zhǎng)的路要走,當(dāng)務(wù)之急就是要解決電網(wǎng)企業(yè)跨國(guó)經(jīng)營(yíng)的法律問題。本文從電網(wǎng)企業(yè)跨國(guó)經(jīng)營(yíng)存在的客觀基礎(chǔ)出發(fā),研究了我國(guó)電網(wǎng)企業(yè)跨國(guó)經(jīng)營(yíng)的幾種基本法律形式以及當(dāng)前跨國(guó)經(jīng)營(yíng)實(shí)踐中遇到的問題,分析了歐盟統(tǒng)一電網(wǎng)的成功經(jīng)驗(yàn),并在此基礎(chǔ)上提出了重構(gòu)電網(wǎng)企業(yè)跨國(guó)經(jīng)營(yíng)法律制度體系的幾點(diǎn)建議。
[Abstract]:Judging from the current situation of world economic development, the energy supply problem will be the most important factor to determine the level and speed of economic development in a long period of time in the future. As a kind of efficient, green energy besides oil and natural gas, electric power not only has the characteristics of clean and safe, but also is the most widely used and most applicable energy. However, power resources, like oil and natural gas, have uneven regional distribution. In the world, some areas are rich in power resources, but the demand for power resources is low, while some regions are relatively short of electricity resources, but the demand for power resources is very large. The distribution of power resources in China belongs to this type. Simply relying on the domestic electricity market to allocate the power resources is not enough to solve the problem. It is also necessary to make full use of the role of the international market in the allocation of power resources and improve the utilization efficiency of power resources. The transnational operation of power grid enterprises is a new attempt for grid enterprises to use international market to allocate regional power resources in response to the call of national "going out" strategy. However, compared with the successful examples such as the European Union unified grid, there is still a long way to go for the transnational operation of our power grid enterprises, and the urgent task is to solve the legal problems of the transnational operation of the power grid enterprises. Based on the objective basis of the transnational operation of power grid enterprises, this paper studies several basic legal forms of transnational operation of power grid enterprises in China and the problems encountered in the practice of transnational operation at present, and analyzes the successful experience of the unified grid in the European Union. On the basis of this, some suggestions on reconstructing the legal system of transnational operation of power grid enterprises are put forward.
