“一帶一路”戰(zhàn)略下我國與沿線國家國際多式聯(lián)運經(jīng)營人責任協(xié)調探析——以“最小網(wǎng)狀責任形式”為視角

【摘要】:國際社會對協(xié)調龐雜的國際多式聯(lián)運網(wǎng)狀立法的嘗試充滿困難,所選擇的經(jīng)營人責任形式也在多元化世界格局下相互沖突。但是,《鹿特丹規(guī)則》通過構建"最小網(wǎng)狀責任形式",在一定程度上與現(xiàn)存接受程度較高的單一運輸公約進行互聯(lián)互通,迂回地使海運規(guī)則"上岸";而取消非海運區(qū)段國內法適用則更好地協(xié)調了貨運雙方利益,節(jié)約了時間成本。我國應結合"一帶一路"戰(zhàn)略下與沿線國家國際多式聯(lián)運發(fā)展現(xiàn)狀,正視已顯現(xiàn)的國際多式聯(lián)運經(jīng)營人責任協(xié)調的法律問題,積極研究評估《鹿特丹規(guī)則》的影響,推進《鹿特丹規(guī)則》生效。同時,應借鑒"最小網(wǎng)狀責任形式"完善我國國內立法,為我國"一帶一路"戰(zhàn)略全面務實提供更強有力的法律助力。
[Abstract]:The international community is full of difficulties in trying to coordinate the international multimodal transport network legislation, and the operator's liability forms are in conflict with each other in the pluralistic world. The Rotterdam rules, however, interconnect to some extent with the existing single transport convention, which has a high degree of acceptance, by constructing a "minimum reticular form of liability", Detour makes the maritime code "disembark", and canceling the application of domestic law of non-maritime section can better coordinate the interests of both parties and save time cost. According to the current situation of the development of international multimodal transport under the strategy of "Belt and Road" and the countries along the route, China should face up to the existing legal problems of the coordination of the responsibilities of international multimodal transport operators and actively study and evaluate the impact of the Rotterdam rules. To promote the entry into force of the Rotterdam rules. At the same time, we should use the "minimum net responsibility form" for reference to perfect our country's domestic legislation, and provide more powerful legal aid for "Belt and Road" strategy.
