【摘要】：隨著地球環(huán)境的污染和破壞問(wèn)題日趨嚴(yán)重,涉外環(huán)境侵權(quán)成為國(guó)內(nèi)外關(guān)注的熱點(diǎn)。然而,涉外環(huán)境侵權(quán)必然涉及到各個(gè)國(guó)家之間的利.益,在先前大多是由國(guó)際公法進(jìn)行調(diào)整。近年來(lái)由于經(jīng)濟(jì)全球化的影響,各國(guó)之間的交流和影響日益繁多,涉外環(huán)境侵權(quán)的調(diào)整也更加趨向于私法化,主要由國(guó)際私法的沖突規(guī)則進(jìn)行調(diào)整。 第一章主要敘述的是涉外環(huán)境侵權(quán)行為的法律沖突,從概念的界定入手,先對(duì)涉外環(huán)境侵權(quán)行為進(jìn)行界定,然后探明涉外環(huán)境侵權(quán)行為的實(shí)質(zhì),最后對(duì)涉外環(huán)境侵權(quán)行為法律沖突的方面進(jìn)行分析。 第二章主要敘述的是涉外環(huán)境侵權(quán)行為的法律適用現(xiàn)狀及發(fā)展趨勢(shì)。首先對(duì)影響涉外環(huán)境侵權(quán)行為法律適用的因素進(jìn)行歸納,其次針對(duì)涉外環(huán)境侵權(quán)行為法律適用的多層次現(xiàn)狀,提出沖突規(guī)則將在涉外環(huán)境侵權(quán)的調(diào)整中發(fā)揮主導(dǎo)作用,以及有利于被害人為主的特殊沖突規(guī)則是涉外環(huán)境侵權(quán)沖突規(guī)則的發(fā)展方向。 第三章根據(jù)我國(guó)涉外環(huán)境侵權(quán)行為法律適用的現(xiàn)狀,思考了我國(guó)涉外環(huán)境侵權(quán)行為的法律適用規(guī)則的完善。主要提出了兩點(diǎn)建議,是積極締約或參加相關(guān)條約,二是在涉外民事法律關(guān)系立法中完善相關(guān)沖突規(guī)則。
[Abstract]:With the pollution and destruction of the earth's environment becoming more and more serious, foreign environmental tort has become a hot spot at home and abroad. However, the foreign-related environmental tort is bound to involve the interests of each country. In the past, most of them were adjusted by public international law. In recent years, due to the impact of economic globalization, the exchange and influence between countries are increasingly various, and the adjustment of environmental tort involving foreign affairs tends to be more private, mainly by the conflict rules of private international law. The first chapter mainly narrates the legal conflict of the environmental tort involving foreign affairs. Starting with the definition of the concept, it defines the environmental tort concerning foreign affairs first, and then finds out the essence of the environmental tort involving foreign affairs. At last, it analyzes the legal conflict of environmental tort. The second chapter mainly narrates the current situation and development trend of the law application of foreign environmental tort. First of all, it summarizes the factors that affect the application of foreign environmental tort law. Secondly, aiming at the multi-level current situation of the application of foreign environmental tort law, it puts forward that the conflict rules will play a leading role in the adjustment of foreign-related environmental tort. And the special conflict rules in favor of victims are the development direction of environmental tort conflict rules concerning foreign affairs. In the third chapter, according to the current situation of the application of the law of environmental tort involving foreign affairs in China, the author thinks about the perfection of the applicable rules of the law of environmental tort involving foreign affairs in our country. Two suggestions are put forward, that is, to sign or participate in relevant treaties actively, and to perfect the relevant conflict rules in the legislation of civil legal relations concerning foreign affairs.
