【摘要】：《生物多樣性公約》建構(gòu)了以遺傳資源利益分享權(quán)為支點(diǎn)的遺傳資源財(cái)產(chǎn)權(quán)�；凇渡锒鄻有怨s》的遺傳資源財(cái)產(chǎn)權(quán),內(nèi)蘊(yùn)著從遺傳資源所有權(quán)遞進(jìn)到遺傳資源特別財(cái)產(chǎn)權(quán)利的法律邏輯,隱藏著遺傳資源所有權(quán)和遺傳資源特別財(cái)產(chǎn)權(quán)利的內(nèi)涵。遺傳資源特別財(cái)產(chǎn)權(quán)利,為我國(guó)制定遺傳資源(財(cái)產(chǎn)權(quán))保護(hù)法提供了理論支持,為生物多樣性和生態(tài)安全提供了私權(quán)保障。
[Abstract]:The Convention on Biological Diversity constructs the property right of genetic resources with the benefit sharing right as its fulcrum. The property right of genetic resources based on the Convention on Biological Diversity contains the legal logic from the ownership of genetic resources to the rights of special property of genetic resources, and hides the connotation of the ownership of genetic resources and the rights of special property of genetic resources. The special property rights of genetic resources provide theoretical support for the formulation of genetic resources (property rights) protection law and private rights protection for biodiversity and ecological security.
