【摘要】：提單是國(guó)際商事活動(dòng)中最為重要的單證之一,運(yùn)輸、貿(mào)易、結(jié)算等領(lǐng)域因之而緊密相連,但是提單也帶來(lái)了諸多的法律問(wèn)題,其中,提單權(quán)利問(wèn)題是關(guān)鍵所在,不僅關(guān)涉眾多當(dāng)事人的切身利益,而且也影響到了運(yùn)輸、貿(mào)易、結(jié)算等領(lǐng)域的良性運(yùn)轉(zhuǎn),對(duì)于提單權(quán)利的諸問(wèn)題予以解答是文章的目的所在。文章主要從提單的社會(huì)功能作為接入點(diǎn),去認(rèn)知提單權(quán)利諸問(wèn)題,澄清困惑,并對(duì)學(xué)界的諸多觀點(diǎn)予以梳理。
[Abstract]:Bill of lading is one of the most important documents in international commercial activities. Transportation, trade, settlement and other fields are closely linked, but Bill of lading brings many legal problems. The bill of lading is the key to the right of bill of lading, which not only concerns the vital interests of many parties, but also affects the virtuous of transportation, trade, settlement and other fields. It is the purpose of the article to answer the questions of the bill of lading rights. The article mainly from the social function of the bill of lading as an access point to recognize the rights of the bill of lading, clarifying the confusion, and combing the views of the academic community.
