【摘要】：人類(lèi)與環(huán)境是處在一種均衡狀態(tài)的博弈雙方，但是，在19世紀(jì)工業(yè)革命之后，人類(lèi)對(duì)環(huán)境生態(tài)系統(tǒng)的破壞開(kāi)始造成了嚴(yán)重的危害后果。20世紀(jì)60年代末國(guó)際貿(mào)易的大幅度發(fā)展，各國(guó)之間的經(jīng)濟(jì)貿(mào)易聯(lián)系日漸加強(qiáng)，人類(lèi)的生活水平得到了飛速提高，但與此同時(shí)一系列環(huán)境問(wèn)題已經(jīng)影響到了人類(lèi)的生存和發(fā)展。在這樣的背景下，人類(lèi)開(kāi)始對(duì)貿(mào)易與環(huán)境的關(guān)系重新審視，如何協(xié)調(diào)貿(mào)易與環(huán)境的關(guān)系也成為20世紀(jì)90年代以來(lái)國(guó)際社會(huì)普遍關(guān)注的焦點(diǎn)問(wèn)題之一。 國(guó)際多邊貿(mào)易體制在世界經(jīng)濟(jì)的高速發(fā)展中發(fā)揮了重要的作用，雖然一定意義上這種體制是環(huán)境惡化的根源，但同時(shí)人們也希望其能夠在解決貿(mào)易與環(huán)境問(wèn)題方面發(fā)揮出同樣重要的作用。1994年世界貿(mào)易組織(WTO)正式成立，成為目前在國(guó)際貿(mào)易領(lǐng)域調(diào)整貿(mào)易與環(huán)境關(guān)系的主要法律制度。因此，我們必須對(duì)WTO法律制度下與環(huán)境有關(guān)的各種規(guī)則的適用性進(jìn)行認(rèn)真研究，探索WTO環(huán)境規(guī)則具體涵義與特點(diǎn)，，揭示W(wǎng)TO環(huán)境規(guī)則的基本內(nèi)容，闡明WTO環(huán)境規(guī)則的內(nèi)在關(guān)系，為完善和構(gòu)建國(guó)內(nèi)符合WTO環(huán)境規(guī)則的完整和有效的環(huán)境法律制度、解決多邊貿(mào)易體制下的貿(mào)易與環(huán)境問(wèn)題提供有益的參考和立法建議。 本文共由六部分構(gòu)成，第一部分為引言，在該部分主要包括研究目的意義、論文主要內(nèi)容、研究的方法、已有的相關(guān)研究、論文的創(chuàng)新。文章的第二部分為WTO環(huán)境規(guī)則概述，主要從WTO環(huán)境規(guī)則的概念與特點(diǎn)、WTO環(huán)境規(guī)則的產(chǎn)生及其發(fā)展演變歷程、WTO環(huán)境規(guī)則的基本內(nèi)容三個(gè)方面進(jìn)行了分析，對(duì)WTO環(huán)境規(guī)則做以簡(jiǎn)單的介紹。第三部分為WTO環(huán)境規(guī)則在我國(guó)的適用，介紹了我國(guó)適用WTO環(huán)境規(guī)則的基本現(xiàn)狀，從中反思了我國(guó)適用WTO環(huán)境規(guī)則過(guò)程中所遭遇到的主要問(wèn)題。第四部分為國(guó)外適用WTO環(huán)境規(guī)則的實(shí)踐，進(jìn)而提出國(guó)外適用WTO環(huán)境規(guī)則的經(jīng)驗(yàn)對(duì)我國(guó)的啟示。第五部分為完善WTO環(huán)境規(guī)則在我國(guó)的適用，主要從WTO環(huán)境規(guī)則國(guó)內(nèi)適用對(duì)我國(guó)立法機(jī)關(guān)的要求、改進(jìn)我國(guó)行政執(zhí)法、建立健全環(huán)境信息公開(kāi)制度及公民參與機(jī)制、改革環(huán)境司法制度以及國(guó)際環(huán)境交流等方面提出了完善對(duì)策。最后為文章結(jié)論，總結(jié)歸納全文。
[Abstract]:Human beings and the environment are both sides of the game in a balanced state. However, after the industrial revolution in the 19th century, the destruction of human beings to the environment ecosystem began to cause serious harm consequences. The international trade developed greatly in the late 1960s. The economic and trade ties between countries have been strengthened day by day, and the living standards of human beings have been rapidly improved, but at the same time a series of environmental problems have affected the survival and development of human beings. Under this background, human beings began to re-examine the relationship between trade and environment, and how to coordinate the relationship between trade and environment has become one of the focuses of international community since 1990s. The international multilateral trading system has played an important role in the rapid development of the world economy, although in a sense it is the source of environmental degradation. But at the same time, people also hope that it can play an equally important role in solving trade and environment problems. In 1994, the World Trade Organization (WTO) was formally established to become the main legal system to adjust the relationship between trade and environment in the field of international trade. Therefore, we must carefully study the applicability of various rules related to environment under WTO legal system, explore the specific meaning and characteristics of WTO environmental rules, reveal the basic contents of WTO environmental rules, and clarify the internal relations of WTO environmental rules. In order to perfect and construct a complete and effective environmental legal system in accordance with the environmental rules of WTO and to solve the trade and environment problems under the multilateral trading system, it provides useful references and legislative suggestions. This paper is composed of six parts. The first part is the introduction. In this part, it mainly includes the significance of the research purpose, the main content of the paper, the research method, the related research, the innovation of the paper. The second part of this paper is an overview of WTO environmental rules, which is mainly analyzed from three aspects: the concept and characteristics of WTO environmental rules and the development and evolution of WTO environmental rules. Brief introduction to WTO environment rules. The third part is the application of WTO environmental rules in our country. It introduces the basic situation of applying WTO environmental rules in China, and reflects on the main problems encountered in the application of WTO environmental rules in China. The fourth part is the practice of applying WTO environmental rules abroad, and then puts forward the enlightenment to our country from the experience of applying WTO environmental rules abroad. The fifth part is to improve the application of WTO environmental rules in our country, mainly from the domestic application of WTO environmental rules to the requirements of our legislative organs, improve our administrative law enforcement, establish and improve the environmental information disclosure system and citizen participation mechanism. The reform of the environmental justice system and international environmental exchanges and other aspects of the improvement of countermeasures. Finally, the conclusion of the article, summing up the full text.
