【摘要】：先行付款制度是作為調整國際航空運輸某些規(guī)定的1999年《蒙特利爾公約》對華沙公約體系現代化和一體化的創(chuàng)新因素之一。該制度在國際航空運輸立法的新時期具有先進性和前瞻性,對保護航空旅客運輸事故中的受害者權益具有一定的法律作用。但是,該制度制定十多年來從理論到實踐當中還存在一些不盡人意的地方,具有軟法性質,實則是一個空虛的法律架構,因而有必要對此制度做必要的考量和檢討,以利于我國正確運用和在國內法中加以合理規(guī)定。
[Abstract]:The advance payment system is one of the innovative factors for the modernization and integration of the Warsaw Convention system under the 1999 Montreal Convention, which regulates certain provisions of international air transport. This system is advanced and forward-looking in the new period of international air transport legislation, and has certain legal function to protect the rights and interests of the victims in air passenger transport accidents. However, since the establishment of this system for more than a decade, there are still some unsatisfactory aspects from theory to practice. It has a soft law nature and is in fact an empty legal framework. Therefore, it is necessary to make the necessary consideration and review of this system. In order to facilitate the correct use of our country and in the domestic law to be reasonable provisions.
