【摘要】：BOT是20世紀八十年代興起的一種新型的投融資方式,BOT投資方式以工程建設為基礎,集合私人經(jīng)營的優(yōu)點,具有很強的融資功能,能有效吸引外資進入基礎設施建設領域,從而緩解東道國建設資金不足的壓力。 本文首先介紹了BOT投資方式的基礎理論,闡述了BOT的法律性質(zhì)、法律關(guān)系和運作過程。然后,探討了發(fā)達國家和地區(qū)與發(fā)展中國家實施BOT項目的不同之處,總結(jié)國外先進的實踐和立法經(jīng)驗。接著,著重介紹了我國采用BOT方式的實踐項目和立法現(xiàn)狀,并對比分析了世界上先進的BOT立法模式,進而明確了我國BOT立法過程中的主要法律問題。最后,結(jié)合我國的現(xiàn)行法律規(guī)定與BOT項目的發(fā)展現(xiàn)狀,指出我國BOT立法過程中應遵循的原則和應克服的障礙。
[Abstract]:BOT is a new type of investment and financing method which rose in 1980s. It is based on project construction and has the advantages of private management. It has a strong financing function and can effectively attract foreign capital into the field of infrastructure construction. In order to alleviate the host country construction funds insufficient pressure. This paper first introduces the basic theory of BOT investment mode, expounds the legal nature, legal relationship and operation process of BOT. Then, the paper discusses the differences between developed countries and developing countries in implementing BOT projects, and summarizes the advanced practice and legislative experience of foreign countries. Then, the paper introduces the practice items and legislation status of adopting BOT mode in our country, compares and analyzes the advanced BOT legislation mode in the world, and then clarifies the main legal problems in the process of BOT legislation in our country. Finally, according to the current laws and regulations of our country and the development status of BOT project, the author points out the principles and obstacles that should be followed and overcome in the process of BOT legislation in our country.
