【摘要】：《聯(lián)合國海洋法公約》和《生物多樣性公約》均未界定國際海底區(qū)域生物資源的法律屬性,這一立法空白既不利于該區(qū)域生物多樣性的保護(hù),也使其開發(fā)、利用處于無序狀態(tài)。由于國際海底區(qū)域生物資源與礦物資源在地理分布上有緊密的聯(lián)系,它還影響了國際海底管理局對區(qū)域礦物資源開發(fā)的統(tǒng)籌管理。本文運用比較研究、邏輯推理等研究方法,論證了國際海底區(qū)域生物資源區(qū)別于公海"魚類",其開發(fā)活動不應(yīng)適用"公海自由",進(jìn)而結(jié)合現(xiàn)有相關(guān)國際立法,從其自然屬性與自然分布特性、開發(fā)管理的實際需求及聯(lián)合國大會、國際海底管理局所采的行動等方面進(jìn)行系統(tǒng)分析,認(rèn)為國際海底區(qū)域生物資源是"人類的共同繼承財產(chǎn)"。
[Abstract]:Neither the United Nations Convention on the Law of the Sea nor the Convention on Biological Diversity have defined the legal attributes of biological resources in the international seabed area. This legislative gap is not conducive to the protection of biodiversity in the region, but also to its exploitation and utilization in a state of disorder. Because of the close relationship between the biological resources and mineral resources in the international seabed area, it also affects the overall management of the exploitation of regional mineral resources by the International seabed Authority. By means of comparative study, logical reasoning and other research methods, this paper proves that the biological resources of the international seabed area are different from the high seas "fish", and their exploitation activities should not be applied to the "freedom of the high seas", and then combined with the existing relevant international legislation. Based on the systematic analysis of its natural attributes and natural distribution characteristics, the actual needs of development and management, the United Nations General Assembly and the actions taken by the International seabed Authority, it is concluded that the biological resources of the international seabed area are "the common heritage of mankind".
