【摘要】：從20世紀(jì)80年代開始,國(guó)際投資中的環(huán)境保護(hù)問題開始引起各個(gè)國(guó)家的重視。隨著全球化的進(jìn)一步深入,國(guó)際投資和環(huán)境保護(hù)之間的矛盾也愈加突出。投資母國(guó)期望獲取最大投資收益,不愿意在國(guó)際投資中承擔(dān)環(huán)境保護(hù)責(zé)任。東道國(guó)為了吸引投資爭(zhēng)取發(fā)展機(jī)會(huì),主動(dòng)或者競(jìng)相降低環(huán)境保護(hù)標(biāo)準(zhǔn),甚至出現(xiàn)“法規(guī)凍結(jié)”現(xiàn)象。為了緩和國(guó)際投資和環(huán)境保護(hù)之間的矛盾,國(guó)際投資協(xié)定中開始出現(xiàn)一些關(guān)注環(huán)境保護(hù)的條款。如美國(guó)《1994年BIT范本》和1994年1月1日生效的《北美自由貿(mào)易協(xié)定》(North American Free Trade Agreement,NAFTA)中都有關(guān)于環(huán)境保護(hù)的內(nèi)容。從2000年“走出去”戰(zhàn)略提出以來,我國(guó)越來越多的企業(yè)走出國(guó)門到海外去投資,目前已成為世界上重要的資本輸出大國(guó)。在對(duì)外投資的過程中,由于不重視投資中的環(huán)境保護(hù)問題,甚至在國(guó)際上一度被指責(zé)為“掠奪性發(fā)展”,“中國(guó)環(huán)境威脅論”、“中國(guó)生態(tài)傾銷論”各種對(duì)中國(guó)形象產(chǎn)生負(fù)面影響的論調(diào)不絕于耳。2013年,習(xí)近平主席提出共建“絲綢之路經(jīng)濟(jì)帶”和“21世紀(jì)海上絲綢之路”的重大倡議,由此,“一帶一路”戰(zhàn)略開始逐步走進(jìn)國(guó)內(nèi)外的視野受到廣泛的關(guān)注。在“一帶一路”推進(jìn)的過程中,我們應(yīng)當(dāng)吸取以往在國(guó)際投資中處理環(huán)境保護(hù)問題的經(jīng)驗(yàn)和教訓(xùn)。本文全文共四個(gè)章節(jié),第一章對(duì)我們國(guó)家“一帶一路”戰(zhàn)略和海外投資進(jìn)行了概述,并提出我國(guó)“一帶一路”戰(zhàn)略下海外投資的環(huán)境保護(hù)存在的問題。第二章從我國(guó)政府、東道國(guó)政府、海外投資企業(yè)三個(gè)方面闡述了我國(guó)海外投資環(huán)境保護(hù)問題的成因。第三章從國(guó)際層面介紹了國(guó)際范圍內(nèi)應(yīng)對(duì)國(guó)際投資的環(huán)境保護(hù)問題的實(shí)踐,為我國(guó)解決“一帶一路”戰(zhàn)略下海外投資的環(huán)境保護(hù)問題提供良好的經(jīng)驗(yàn)借鑒。第四章是本文的重點(diǎn)章節(jié),在研究我國(guó)“一帶一路”戰(zhàn)略海外投資中存在的環(huán)境保護(hù)問題及其成因的基礎(chǔ)上,并借鑒國(guó)際成功的管理經(jīng)驗(yàn),提出了在“一帶一路”戰(zhàn)略下我國(guó)如何應(yīng)對(duì)的策略。
[Abstract]:Since 1980's, environmental protection in international investment has attracted the attention of all countries.With the further development of globalization, the contradiction between international investment and environmental protection is becoming more and more prominent.The home country expects to maximize the return on investment and is unwilling to take responsibility for environmental protection in international investment.In order to attract investment and strive for development opportunities, host countries take the initiative or compete to lower the environmental protection standards, and even appear the phenomenon of "legal freeze".In order to ease the contradiction between international investment and environmental protection, some clauses concerning environmental protection appear in IIAS.For example, the United States' BIT Model 1994 and the North American Free Trade Agreement (NAFTAA), which entered into force on January 1, 1994, contain the contents of environmental protection.Since the "going out" strategy was put forward in 2000, more and more enterprises in China have gone abroad to invest, and have become an important capital exporting country in the world.In the process of overseas investment, due to the lack of attention to environmental protection in investment, it was even criticized internationally as "predatory development" and "China's environmental threat theory."In 2013, President Xi Jinping proposed a major initiative to jointly build the "Silk Road Economic Belt" and the "21st Century Maritime Silk Road".Belt and Road's strategy began to gradually enter the domestic and foreign field of vision and received extensive attention.In the course of promoting Belt and Road, we should draw lessons from past experiences and lessons in dealing with environmental protection in international investment.There are four chapters in this paper. The first chapter summarizes the strategy of "Belt and Road" and overseas investment in our country, and puts forward the problems of environmental protection of overseas investment under the strategy of "Belt and Road" of our country.The second chapter expounds the causes of overseas investment environment protection from three aspects: our government, host government and overseas investment enterprises.The third chapter introduces the practice of dealing with the environmental protection problem of international investment from the international level, and provides a good experience for our country to solve the environmental protection problem of overseas investment under the strategy of "Belt and Road".The fourth chapter is the key chapter of this paper, on the basis of studying the environmental protection problems and their causes in China's "Belt and Road" strategy overseas investment, and drawing lessons from international successful management experience.This paper puts forward the strategy of how to deal with it under the strategy of Belt and Road.
