【摘要】：正本說(shuō)明反映世界知識(shí)產(chǎn)權(quán)組織(WIPO)國(guó)際局關(guān)于執(zhí)行《伯爾尼公約》第18條規(guī)定的觀點(diǎn)。應(yīng)當(dāng)認(rèn)為,對(duì)公約的任何正式解釋是公約各成員方的事情。1.有關(guān)適用《伯爾尼公約》追溯保護(hù)義務(wù)的基本規(guī)定包含在公約第18條第(1)款和第(2)款:(1)本公約適用于所有在本公約生效時(shí)尚未在來(lái)源國(guó)因保護(hù)期屆滿而進(jìn)入公有領(lǐng)域的作品。(2)然而,在被請(qǐng)求保護(hù)國(guó)已因先前規(guī)定的保護(hù)期屆滿而進(jìn)入公有領(lǐng)域的作品,不再重新受到保護(hù)。
[Abstract]:The original note reflects the views of the International Bureau of the World intellectual property Organization (WIPO) on the implementation of article 18 of the Berne Convention.It should be considered that any formal interpretation of the Convention is a matter for the parties to the Convention.The basic provisions on the retroactive application of the Berne Convention are contained in articles 18 (1) and 2 (2): 1 of the Convention.) the Convention applies to all States of origin that have not entered into public ownership by reason of the expiry of the term of protection at the time of entry into force of this Convention.However,Works that have entered the public domain as a result of the expiration of the previously stipulated period of protection in the requested State shall not be re-protected.
