【摘要】：根據(jù)國(guó)際人權(quán)公約權(quán)利限制條款的規(guī)定,締約國(guó)可以在保護(hù)公共利益或他人利益所必需的前提下限制個(gè)人權(quán)利的行使。締約國(guó)限制個(gè)人權(quán)利的行使,除應(yīng)遵守權(quán)利限制條款所規(guī)定的法定限制條件之外,還應(yīng)遵循蘊(yùn)含在其中的合法性原則、必要性原則、非歧視原則和禁止濫用限制原則。這四項(xiàng)基本原則表明權(quán)利限制條款更多地體現(xiàn)出限制性功能,權(quán)利限制條款的重點(diǎn)不是限制人權(quán)而是保護(hù)人權(quán)。我國(guó)應(yīng)在借鑒國(guó)際人權(quán)公約權(quán)利限制的基本原則的基礎(chǔ)上,進(jìn)一步完善憲法公民基本權(quán)利限制的基本原則體系。
[Abstract]:According to the provisions of the rights limitation clause in international human rights conventions, States parties may restrict the exercise of individual rights if it is necessary to protect the public interest or the interests of others.In order to restrict the exercise of individual rights, States parties should abide by the principle of legality, the principle of necessity, the principle of non-discrimination and the principle of prohibition against abuse of restrictions.These four basic principles indicate that the restrictive clauses embody more restrictive functions, and the emphasis of the restrictive clauses is not on the restriction of human rights but on the protection of human rights.On the basis of drawing lessons from the basic principles of the restriction of rights in international human rights conventions, our country should further improve the basic principle system of the restriction of the fundamental rights of constitutional citizens.
