【摘要】：可再生能源貿(mào)易以其綠色、循環(huán)、低碳的獨(dú)特優(yōu)勢(shì)日益成為各國(guó)進(jìn)行對(duì)外貿(mào)易的焦點(diǎn),在進(jìn)行對(duì)外貿(mào)易的過(guò)程中,不可避免地會(huì)引起各種各樣的貿(mào)易爭(zhēng)端。然而,在當(dāng)今的WTO框架體系內(nèi),系統(tǒng)性規(guī)制可再生能源貿(mào)易的法律體系尚屬空白,導(dǎo)致可再生能源貿(mào)易爭(zhēng)端頻發(fā)且難以合理高效地解決。長(zhǎng)此以來(lái),不僅阻礙爭(zhēng)端的解決進(jìn)程,而且極易影響各國(guó)進(jìn)行可再生能源貿(mào)易的積極性,不利于世界經(jīng)濟(jì)的進(jìn)步。為了改善這一情況,筆者將根據(jù)當(dāng)前的實(shí)際情況,結(jié)合案例以及傳統(tǒng)的爭(zhēng)端解決方法和原則,探尋WTO框架體系內(nèi)解決可再生能源貿(mào)易爭(zhēng)端的模式。同時(shí),從我國(guó)的基本國(guó)情及國(guó)家政策出發(fā),結(jié)合WTO框架下可再生能源貿(mào)易爭(zhēng)端模式,提出應(yīng)對(duì)可再生能源貿(mào)易爭(zhēng)端的策略,從而使得我國(guó)的可再生能源貿(mào)易能夠在WTO框架體系內(nèi)健康有序地發(fā)展。
[Abstract]:Renewable energy trade with its unique advantages of green, recycling, low carbon has become the focus of foreign trade. In the process of foreign trade, it will inevitably lead to a variety of trade disputes.However, in the current WTO framework system, the legal system of systematic regulation of renewable energy trade is still blank, which leads to frequent disputes on renewable energy trade and difficult to solve reasonably and efficiently.In the long run, it not only hinders the process of dispute settlement, but also affects the enthusiasm of countries to trade in renewable energy, which is not conducive to the progress of the world economy.In order to improve this situation, the author will explore the model of resolving the trade dispute of renewable energy within the framework of WTO system according to the actual situation, cases and traditional dispute settlement methods and principles.At the same time, according to the basic national conditions and national policies of our country, combined with the renewable energy trade dispute model under the framework of WTO, this paper puts forward the strategy to deal with the renewable energy trade dispute.Therefore, the renewable energy trade in China can develop healthily and orderly within the framework of WTO.
