【摘要】：在多邊體制下連續(xù)受挫之后,美國政府和私人集團在重返知識產(chǎn)權(quán)保護的雙邊主義上不謀而合,通過完善的機構(gòu)設(shè)置和明晰的制度安排,以經(jīng)濟力量的施加作為決定性手段,輔之以觀念塑造、能力建設(shè)援助等各種隱蔽方法,美國FTA中的TRIPS-plus規(guī)則得以建立。其中,私人集團的運作起著重要作用,美國貿(mào)易伙伴以知識產(chǎn)權(quán)保護換取市場準入、關(guān)稅減讓等經(jīng)濟利益和其他非關(guān)稅利益,也是TRIPS-plus規(guī)則在全球擴張的重要因素。
[Abstract]:After successive setbacks under the multilateral system, the United States government and private groups coincided with each other in returning to bilateralism in the protection of intellectual property rights, using the imposition of economic power as a decisive means through sound institutional set-up and clear institutional arrangements.Supplemented by a variety of covert approaches, such as concept building and capacity-building assistance, the TRIPS-plus rules in the US FTA were established.Among them, the operation of private groups plays an important role. American trading partners exchange intellectual property rights protection for market access, tariff concessions and other non-tariff interests, which is also an important factor in the global expansion of TRIPS-plus rules.
