【摘要】：以二氧化碳為主的溫室氣體過(guò)量排放所引發(fā)的氣候變化問(wèn)題,越來(lái)越受到國(guó)際社會(huì)的普遍關(guān)注。如何有效控制二氧化碳排放量,減緩全球氣候變暖速度,已經(jīng)成為世界各國(guó)政治、經(jīng)濟(jì)、外交、環(huán)保、能源等領(lǐng)域的重要議題。國(guó)際氣候變化與環(huán)境領(lǐng)域相關(guān)公約規(guī)定的發(fā)達(dá)國(guó)家和發(fā)展中國(guó)家在溫室氣體減排方面權(quán)利與義務(wù)的差異,使得由環(huán)境引發(fā)的貿(mào)易沖突頻發(fā),并深深地觸及到各國(guó)的核心利益。這種因環(huán)境問(wèn)題引發(fā)的生存權(quán)與發(fā)展權(quán)、發(fā)展成本與發(fā)展空間的再調(diào)控與再配置,已經(jīng)成為當(dāng)前乃至今后一段時(shí)間內(nèi),世界各國(guó)經(jīng)濟(jì)發(fā)展模式、政治立場(chǎng)與外交博弈的新焦點(diǎn)。碳關(guān)稅措施也正是基于這樣一個(gè)深層次的背景而提出的。 本文從碳關(guān)稅的產(chǎn)生背景發(fā)端,在厘清碳關(guān)稅與相關(guān)概念的區(qū)別之后,界定出：碳關(guān)稅是一種新的邊境調(diào)節(jié)措施,并不等同于關(guān)稅；繼而詳細(xì)論證了碳關(guān)稅在當(dāng)前不符合國(guó)際氣候變化領(lǐng)域相關(guān)公約的原則及GATT/WTO的具體規(guī)定,并運(yùn)用WTO爭(zhēng)端解決機(jī)制中的典型案例和簡(jiǎn)易經(jīng)濟(jì)學(xué)原理論證了碳關(guān)稅運(yùn)行機(jī)制的暫時(shí)無(wú)效性和限制碳排放效果的不確定性,從而把國(guó)際范圍內(nèi)解決氣候變化問(wèn)題的重點(diǎn)放在碳排放權(quán)交易機(jī)制的完善與碳減排技術(shù)先進(jìn)國(guó)家措施的借鑒與推廣上,重點(diǎn)論述了我國(guó)應(yīng)對(duì)碳關(guān)稅的路徑選擇：除了政治、經(jīng)濟(jì)、外交等領(lǐng)域的措施外,當(dāng)務(wù)之急是在法律體系內(nèi)出臺(tái)我國(guó)的碳稅法,并完善我國(guó)碳排放交易的操作流程。
[Abstract]:The problem of climate change caused by excessive emissions of carbon dioxide has attracted more and more attention from the international community.How to effectively control carbon dioxide emissions and slow down the rate of global warming has become an important issue in politics, economy, diplomacy, environmental protection, energy and other fields around the world.The difference between the rights and obligations of developed and developing countries in greenhouse gas emission reduction stipulated by the relevant conventions in the field of climate change and environment makes the trade conflicts caused by the environment frequent and deeply touches the core interests of each country.The right to survival and development, the development cost and the reconfiguration of development space caused by environmental problems have become the new focus of the economic development model, political stand and diplomatic game in the world for a period of time, even in the future.Carbon tariff measures are also based on such a deep background and proposed.Based on the background of carbon tariff and the difference between carbon tariff and related concepts, this paper defines that carbon tariff is a new border regulation measure, which is not equal to tariff;Then it demonstrates in detail that carbon tariffs are not in accordance with the principles of the relevant international conventions in the field of climate change and the specific provisions of the GATT/WTO.Using the typical cases and simple economic principles of WTO dispute settlement mechanism, the paper demonstrates the temporary inefficiency of carbon tariff operation mechanism and the uncertainty of the effect of limiting carbon emissions.Therefore, the focus of the international solution to the problem of climate change is the perfection of carbon emission trading mechanism and the reference and promotion of advanced national measures of carbon abatement technology, and the choice of ways to deal with carbon tariffs in China is emphasized: besides politics,In addition to the measures in the fields of economy and diplomacy, it is urgent to introduce the carbon tax law in the legal system and perfect the operation flow of carbon emissions trading in our country.
