【摘要】：聯(lián)合國人權機制對于制定和實施國際人權法發(fā)揮著重要作用,同時也受到政治化、資源匱乏和制度設計缺陷等問題的困擾。聯(lián)合國人權機制的整合是完善該機制的重要途徑,體現(xiàn)了人權主流化和通過多邊合作強化國際人權監(jiān)督的思想。聯(lián)合國每個人權機制內部、機制間以及對機制外部的人權資源的整合,在加強整個人權機制監(jiān)督全面性、整體性、協(xié)調性、一致性和持續(xù)性的同時,也對各國實踐帶來了挑戰(zhàn)。聯(lián)合國人權機制的整合彌補了該機制原有的監(jiān)督空白,將所有國家和地區(qū)的人權狀況全面納入了國際監(jiān)督體系。它通過強化機制間的合作,不僅使聯(lián)合國人權機制內部的資源得到重新配置和有效利用,而且增強了整個機制對于一國人權問題的聚焦能力以及實施力度。此外,整合趨勢在強化聯(lián)合國人權機制與其他國際和國內組織合作的同時,還增強了該機制對于人權監(jiān)督的全面性和多元化。對此,各國需要重視聯(lián)合國人權機制的這一發(fā)展變化,通過加大對聯(lián)合國人權公約以及監(jiān)督機制的接受程度,切實提高國內人權狀況和對國際人權建議的執(zhí)行力度,進一步加強與該機制的全面合作,從而促進國際人權保障。
[Abstract]:United Nations human rights mechanisms play an important role in the formulation and implementation of international human rights law, but also suffer from politicization, lack of resources and institutional design deficiencies.The integration of the United Nations human rights mechanism is an important way to perfect the mechanism, which embodies the idea of human rights mainstreaming and strengthening international human rights monitoring through multilateral cooperation.The integration of human rights resources within, among and outside the United Nations human rights mechanisms not only strengthens the integrity, integrity, coordination, consistency and continuity of the human rights mechanisms, but also challenges the practice of various countries.The integration of the United Nations human rights mechanism has filled the existing monitoring gap of the mechanism and integrated the human rights situation of all countries and regions into the international monitoring system.By strengthening inter-mechanism cooperation, it not only reconfigures and effectively utilizes resources within the United Nations human rights machinery, but also strengthens the focus and implementation of the entire mechanism on human rights issues in a country.In addition, the trend of integration not only strengthens the cooperation between the United Nations human rights mechanisms and other international and domestic organizations, but also enhances the comprehensiveness and pluralism of human rights monitoring by the United Nations human rights mechanisms.In this regard, States need to pay attention to this development of the United Nations human rights mechanisms and to effectively enhance the domestic human rights situation and the implementation of international human rights recommendations by increasing their acceptance of United Nations human rights conventions and monitoring mechanisms,Further strengthen full cooperation with the mechanism, thereby promoting international human rights guarantees.
