【摘要】:專屬經(jīng)濟(jì)區(qū)是第三次聯(lián)合國(guó)海洋法大會(huì)劃分的海域之一,《聯(lián)合國(guó)海洋法公約》(以下簡(jiǎn)稱《公約》)確立了專屬經(jīng)濟(jì)區(qū)的存在,給予其獨(dú)立的海洋法地位!豆s》生效后,沿海國(guó)有權(quán)對(duì)原本屬于公海的海域主張200海里的專屬經(jīng)濟(jì)區(qū)。航行自由是海洋自由的首要體現(xiàn),專屬經(jīng)濟(jì)區(qū)的航行自由與公海的航行自由在《公約》生效后應(yīng)該界限清晰。但是,《公約》是一個(gè)妥協(xié)的產(chǎn)物,關(guān)于專屬經(jīng)濟(jì)區(qū)航行自由的很多問(wèn)題,《公約》都采取了模糊處理,尤其是對(duì)航行自由的限制,《公約》或是援引其有關(guān)公海的相關(guān)條款,或是用原則性的一般規(guī)定給予限制,這降低了《公約》的可操作性。從國(guó)際法和國(guó)內(nèi)法兩方面來(lái)看,專屬經(jīng)濟(jì)區(qū)航行自由制度還存在可操作性差、與公海航行自由制度界限不明等問(wèn)題。進(jìn)而從《公約》的修正、國(guó)際軟法向硬法的發(fā)展和我國(guó)相關(guān)國(guó)內(nèi)立法的完善等方面對(duì)專屬經(jīng)濟(jì)區(qū)航行自由制度的發(fā)展進(jìn)行預(yù)判。
[Abstract]:The exclusive economic zone is one of the sea areas divided by the third United Nations Conference on the Law of the Sea. The United Nations Convention on the Law of the Sea (hereinafter referred to as the Convention) establishes the existence of the exclusive economic zone and gives it independent law of the sea status. After the entry into force of the Convention,Coastal states have the right to claim an exclusive economic zone of 200 nautical miles over sea areas that are originally on the high seas.Freedom of navigation is the primary embodiment of freedom of the sea. The limits of freedom of navigation in the exclusive economic zone and in the high seas should be clear after the entry into force of the Convention.However, the Convention is a product of compromise, and with regard to many of the issues relating to freedom of navigation in the exclusive economic zone, the Convention has taken a vague approach, in particular with regard to restrictions on freedom of navigation, the Convention or invoking its relevant provisions on the high seas,Or limit it with general rules of principle, which reduces the operability of the Convention.From the two aspects of international law and domestic law, the freedom of navigation system of exclusive economic zone has some problems such as poor maneuverability and unclear boundary with freedom of navigation system of high seas.Furthermore, the development of the freedom of navigation system in the exclusive economic zone is forecasted from the aspects of the amendment of the Convention, the development of the international soft law to the hard law and the perfection of the relevant domestic legislation of our country.
