論海商事糾紛解決及相關(guān)法律制度的完善

【摘要】:海商事糾紛作為我國民商事糾紛的一種,具有其獨(dú)有的特點(diǎn)。與之相對(duì)應(yīng),海商事糾紛解決制度也具有一定的特殊性。我國目前的海事糾紛解決途徑主要有海事訴訟、海事仲裁和海事調(diào)解三種。雖然這些糾紛解決方式在我國海商事糾紛解決工作中發(fā)揮了重要作用,但是與航運(yùn)發(fā)達(dá)國家的海事糾紛解決制度以及國際規(guī)則相比,我國的海事糾紛解決制度仍然存在諸多問題。當(dāng)前形勢(shì)下,我國海洋運(yùn)輸和航運(yùn)服務(wù)業(yè)發(fā)展迅速。因此,為了保障航運(yùn)事業(yè)持續(xù)健康穩(wěn)定發(fā)展,構(gòu)建和完善我國的海商事糾紛解決機(jī)制及相關(guān)的法律制度,已經(jīng)勢(shì)在必行。本文以國際經(jīng)濟(jì)法、海商法、訴訟仲裁法的相關(guān)理論為基礎(chǔ),運(yùn)用比較研究和實(shí)務(wù)分析的方法,借鑒現(xiàn)行有效的國際規(guī)則、慣例和國內(nèi)外法律法規(guī)的規(guī)定,提出完善我國海事司法體系和相關(guān)法律制度的建議。在此基礎(chǔ)上,本文以泛北部灣區(qū)域航運(yùn)中心建設(shè)和海事糾紛解決制度的建構(gòu)為視角,就修訂中國—東盟自由貿(mào)易區(qū)《全面經(jīng)濟(jì)合作框架協(xié)議爭(zhēng)端解決機(jī)制協(xié)議》以適用于海事糾紛解決工作提出具體構(gòu)想。 據(jù)此,本文共分為五章。 第一章“海商事糾紛與糾紛解決制度”。該章的第一節(jié)對(duì)海事和海商、海商事糾紛的含義以及海商事糾紛的特征和種類進(jìn)行了介紹。然后,在此基礎(chǔ)上,第二節(jié)探討了海商事糾紛解決的途徑,主要包括海事訴訟、海事仲裁和海事調(diào)解。 第二章“英美海事訴訟仲裁制度比較研究”。比較研究外國,尤其是航運(yùn)發(fā)達(dá)國家的海事訴訟仲裁制度,對(duì)完善我國的海事糾紛解決機(jī)制和相關(guān)法律制度具有重要的參照價(jià)值。該章第一節(jié)對(duì)英國的海事訴訟仲裁制度進(jìn)行了介紹,涉及到英國的民事訴訟規(guī)則和仲裁法的規(guī)定。然后第二節(jié)介紹了美國的海事訴訟仲裁制度,主要包括美國民事訴訟程序規(guī)則、海事特別程序規(guī)則和美國的仲裁法律制度。 第三章“我國海事糾紛解決制度的現(xiàn)狀及問題”。該章主要討論了我國海事糾紛解決機(jī)制的現(xiàn)狀和相關(guān)法律制度中存在的問題。第一節(jié)在概括我國海事司法制度現(xiàn)狀的基礎(chǔ)上,指出了我國海事法院體系設(shè)置和專屬管轄制度中存在的問題。第二節(jié)對(duì)我國海事仲裁制度的現(xiàn)狀及發(fā)展的困境進(jìn)行了分析。第三節(jié)講述了我國海事調(diào)解制度的現(xiàn)狀及問題。 第四章“完善我國海商事糾紛解決制度的建議”。針對(duì)第三章中提出的問題,該章就上述問題的解決提出了具體的建議。第一節(jié)首先明確了完善我國海商事糾紛解決制度應(yīng)當(dāng)堅(jiān)持和貫徹的原則。第二節(jié)對(duì)海事派出法庭的建設(shè)、海事上訴法院的建立和海事法院的受案范圍等方面,提出了具體的構(gòu)想。第三節(jié)在借鑒聯(lián)合國貿(mào)易法委員會(huì)頒布的仲裁規(guī)則和示范法的基礎(chǔ)上,就修訂我國的仲裁法和發(fā)展海事仲裁事業(yè)給予了相應(yīng)的意見。第四節(jié)對(duì)如何構(gòu)建和發(fā)展我國的海事調(diào)解制度,從國際規(guī)則和國內(nèi)現(xiàn)有立法的基礎(chǔ)上,給出了具體的思路和建議。 第五章“泛北部灣區(qū)域航運(yùn)中心建設(shè)及海事糾紛解決制度的完善”。該章是對(duì)泛北部灣區(qū)域航運(yùn)中心建設(shè)和海商事糾紛解決制度的專門研究。第一節(jié)講述了建設(shè)泛北部灣區(qū)域航運(yùn)中心的意義和有利條件。第二節(jié)突出介紹了海事糾紛解決制度對(duì)泛北部灣區(qū)域航運(yùn)中心建設(shè)的促進(jìn)作用。第三節(jié)在對(duì)構(gòu)建泛北部灣海事糾紛解決制度兩種途徑進(jìn)行分析的基礎(chǔ)上,提出了修訂中國—東盟自由貿(mào)易區(qū)《爭(zhēng)端解決協(xié)議》以適用于海事糾紛解決的具體構(gòu)想。
[Abstract]:Maritime disputes as a kind of civil and commercial disputes I, with its unique characteristics. Correspondingly, the system also has the certain particularity of the maritime dispute settlement. The main maritime litigation of China's current maritime dispute solution, maritime arbitration and maritime mediation. Although these three kinds of way to solve the dispute settlement played an important role in our country's maritime dispute, but with shipping developed countries maritime dispute resolution system and international rules compared to solve China's maritime disputes system still exists many problems. The current situation, the development of China's marine transport and shipping services quickly. Therefore, in order to ensure the healthy and stable development of shipping industry, and perfect the construction of China's maritime dispute settlement mechanism and the relevant legal system is imperative. Based on the international economic law, maritime law, related litigation and Arbitration Law On the basis of using the method of comparative research and practice analysis, draw on the existing effective international rules and conventions and domestic laws and regulations, proposed consummates our country maritime judicial system and relevant legal system. According to this, this paper is divided into five chapters.

Then the second section introduces the American system of maritime litigation and arbitration, including the rules of civil procedure, the Special Maritime Procedure Rules and American Arbitration Legal System.
The third chapter "maritime disputes in China to solve the present situation and problems of the system. This chapter mainly discusses the present situation of the maritime dispute settlement mechanism in our country and the relevant problems in the legal system. The first section generalizes the present situation of maritime judicial system in our country, pointed out the existence of China's maritime court system and exclusive jurisdiction the status and development of Maritime Arbitration System in China in the second quarter difficulties were analyzed. The third section is about the current situation and problems of China's maritime mediation system.
The fourth chapter is "the perfection of our country's maritime dispute settlement system" proposed. Aiming at the issues raised in the third chapter, this chapter will solve the above problems and put forward the concrete suggestion. The first section gives a clear improvement of our country's maritime dispute settlement system should adhere to and implement the principle. The second section of the construction of the maritime court. The court of appeal, maritime and maritime court established by the scope and other aspects, and puts forward concrete suggestions. The third section on the basis of promulgation of UNCITRAL Arbitration Rules and the demonstration method, gives the corresponding suggestions to revise the Chinese arbitration law and the development of maritime arbitration. The fifth chapter "the Pan Beibu Gulf regional shipping center construction and maritime dispute resolution system". This chapter is devoted to the study of solving system of Pan Beibu Gulf regional shipping center construction and maritime disputes. The first section is about the construction of Pan Beibu Gulf regional shipping center of the significance and favorable conditions. The second section introduces the maritime dispute to solve the promotion system on the construction of Pan Beibu Gulf regional shipping center. The third section on the basis of analyzing the construction of Pan Beibu Gulf maritime disputes in two ways to solve the system, put forward the revised Chinese ASEAN Free Trade Zone "dispute settlement agreement" to apply specific conception for maritime disputes.
