【摘要】：當(dāng)今我們面臨的客觀事實(shí)是,由于不斷加劇的自然蛻變過程、過度發(fā)展的城市化和旅游業(yè),大規(guī)模公共或私人工程的建設(shè)等因素,諸多世界文化遺產(chǎn)正遭受著嚴(yán)重威脅。1972年聯(lián)合國教科文組織于《世界遺產(chǎn)公約》中確立了世界文化遺產(chǎn)的概念及保護(hù)內(nèi)容,對(duì)于保護(hù)人類共同的文化遺產(chǎn)具有里程碑式的重大意義。隨著文化遺產(chǎn)申請(qǐng)項(xiàng)目與日俱增,越來越多文化遺產(chǎn)被列入人類共同遺產(chǎn)的保護(hù)范圍,保護(hù)世界文化遺產(chǎn)成為一項(xiàng)關(guān)乎人類共同利益的全球性事務(wù),與世界文化遺產(chǎn)保護(hù)有關(guān)的國際法理論和制度亦隨之不斷發(fā)展。世界文化遺產(chǎn)保護(hù)是一個(gè)涉及領(lǐng)域廣泛的問題,在世界文化遺產(chǎn)保護(hù)進(jìn)程中,國際法的發(fā)展也為文化遺產(chǎn)保護(hù)提供了法律機(jī)制保障,如何完善相關(guān)保護(hù)機(jī)制使其更好地為保護(hù)世界文化遺產(chǎn)提供服務(wù),亦成為國際社會(huì)尚待解決的問題。通過對(duì)現(xiàn)有的國際法規(guī)定進(jìn)行研究,筆者嘗試通過歸納、文獻(xiàn)研究等方法,從如下四個(gè)部分對(duì)世界文化遺產(chǎn)保護(hù)進(jìn)行闡述。本文第一部分,概述世界文化遺產(chǎn)的保護(hù)現(xiàn)狀,對(duì)相關(guān)概念、標(biāo)準(zhǔn)以及現(xiàn)狀進(jìn)行分析,提出將世界文化遺產(chǎn)作為人類共同記憶加以保護(hù)具有傳承多元傳統(tǒng)文化,積淀民族精神,保護(hù)人文環(huán)境等重要意義。目前世界文化遺產(chǎn)保護(hù)面對(duì)污染、劫掠、武裝沖突、不受控制的旅游業(yè)、無節(jié)制的城市發(fā)展和自然災(zāi)害等問題,闡述人類共同利益、人類共同遺產(chǎn)等傳統(tǒng)理念對(duì)保護(hù)世界文化遺產(chǎn)的局限性,著重提出人類共同記憶理念界定以及該理念提出的重大現(xiàn)實(shí)意義。本文第二部分,詳細(xì)分析了世界文化遺產(chǎn)國際法保護(hù)的依據(jù),圍繞《世界遺產(chǎn)公約》及相關(guān)規(guī)定進(jìn)行闡述,分析國際法保護(hù)體系的框架,介紹從公約到法律文件在相關(guān)問題上的原則和措施,為下文論述世界文化遺產(chǎn)的保護(hù)機(jī)制提供法律依據(jù)與實(shí)踐參照。本文第三部分,具體闡述世界文化遺產(chǎn)的國際法保護(hù)機(jī)制,分別論述了國際法上針對(duì)世界文化遺產(chǎn)方面的組織機(jī)制、確認(rèn)機(jī)制、資金機(jī)制、監(jiān)督機(jī)制、除名機(jī)制,并針對(duì)這些機(jī)制在各國實(shí)踐中存在的問題做進(jìn)一步分析。本文第四部分,針對(duì)世界文化遺產(chǎn)保護(hù)的進(jìn)一步完善展開闡述,在前兩章分析基礎(chǔ)上提出完善世界文化遺產(chǎn)保護(hù)的國際法機(jī)制,加強(qiáng)法律機(jī)制的有效實(shí)施這兩方面設(shè)想。通過解決現(xiàn)有保護(hù)機(jī)制存在的問題以及強(qiáng)化組織機(jī)構(gòu)職能、公眾參與和國際合作等角度提出相應(yīng)對(duì)策,以期對(duì)改進(jìn)世界文化遺產(chǎn)保護(hù)有所助益。論文立足于國際法視角,以促進(jìn)世界文化遺產(chǎn)保護(hù)工作的完善為目的,梳理以《世界遺產(chǎn)公約》為中心的立法體系,對(duì)相關(guān)概念、標(biāo)準(zhǔn)以及實(shí)施中的組織機(jī)制、確認(rèn)機(jī)制、監(jiān)測(cè)機(jī)制等進(jìn)行分析,建議在國際法機(jī)制的健全和推動(dòng)有效實(shí)施方面加以改進(jìn),從而更好地保護(hù)世界文化遺產(chǎn),保存與傳承其中所凝結(jié)的人類共同記憶。
[Abstract]:The objective fact we face today is that due to the ever-increasing process of natural transformation, over-developed urbanization and tourism, large-scale construction of public or private projects, and so on,Many of the world's cultural heritage are under serious threat. The United Nations Educational, Scientific and Cultural Organization (UNESCO) established the concept and protection of the world cultural heritage in the 1972 UNESCO World Heritage Convention.For the protection of the common cultural heritage of mankind has a landmark significance.With the increasing number of applications for cultural heritage, more and more cultural heritage has been included in the protection of the common heritage of mankind, and the protection of the world cultural heritage has become a global affair of the common interest of mankind.The theory and system of international law related to the protection of world cultural heritage have also developed continuously.The protection of the world cultural heritage is a problem involving a wide range of fields. In the process of the protection of the world cultural heritage, the development of international law also provides a legal mechanism for the protection of the cultural heritage.How to perfect the relevant protection mechanism to provide better service for the protection of the world cultural heritage has also become a problem to be solved by the international community.Through the study of the existing provisions of international law, the author tries to elaborate the protection of world cultural heritage from the following four parts by means of induction, literature research and other methods.The first part of this paper summarizes the current situation of the protection of the world cultural heritage, analyzes the related concepts, standards and present situation, and proposes that the protection of the world cultural heritage as the common memory of mankind has the heritage of multiple traditional cultures and the accumulation of national spirit.Protection of the human environment and other important significance.At present, the protection of the world's cultural heritage, in the face of pollution, looting, armed conflict, uncontrolled tourism, uncontrolled urban development and natural disasters, describes the common interests of mankind.The limitations of traditional concepts such as human common heritage on the protection of world cultural heritage are emphasized. The definition of the concept of human common memory and its great practical significance are put forward.In the second part of this paper, the basis of the international law protection of the world cultural heritage is analyzed in detail, and the framework of the international law protection system is analyzed according to the "World Heritage Convention" and its relevant provisions.This paper introduces the principles and measures on the related issues from the Convention to the legal documents, and provides the legal basis and practical reference for the following discussion on the protection mechanism of the world cultural heritage.In the third part of this paper, the international law protection mechanism of the world cultural heritage is elaborated, and the organization mechanism, the confirmation mechanism, the fund mechanism, the supervision mechanism and the delisting mechanism of the world cultural heritage in international law are discussed respectively.Further analysis is made on the problems existing in the practice of these mechanisms.In the fourth part of this paper, the author expounds the further perfection of the world cultural heritage protection, and puts forward the two tentative ideas of perfecting the international law mechanism of the world cultural heritage protection and strengthening the effective implementation of the legal mechanism on the basis of the analysis of the first two chapters.Through solving the problems existing in the existing protection mechanism and strengthening the functions of the organization, public participation and international cooperation, the corresponding countermeasures are put forward in order to help to improve the protection of the world cultural heritage.Based on the perspective of international law, in order to promote the improvement of the protection of world cultural heritage, the paper combs the legislative system centered on the "World Heritage Convention", and confirms the relevant concepts, standards and organizational mechanisms in implementation.Through the analysis of the monitoring mechanism, it is suggested that the improvement of the mechanism of international law and the promotion of effective implementation should be carried out in order to better protect the world cultural heritage and preserve and inherit the common memory of mankind condensed therein.
