【摘要】：東海是中國的三大邊緣海之一。近年來中日兩國因為東海大陸架劃界、釣魚島歸屬等問題糾紛不斷。本文從國際法的角度論述了當(dāng)今中日東海爭端的由來和解決前景。文章首先介紹了東海的地理位置和戰(zhàn)略地位以及中日東海問題的起因和發(fā)展趨勢。而后介紹在國際法中關(guān)于大陸架劃界的規(guī)定,對釣魚島和沖繩海槽在東海大陸架劃界問題中的地位進(jìn)行了介紹、并描述了中日兩國各自對釣魚島和沖繩海槽地位的理解。之后介紹中日兩國在東海大陸架劃界問題上的立場和依據(jù),并以國際法和國際判例駁斥了日方“中間線”原則的不適用性。最后文章進(jìn)一步探討中日東海問題的解決方式和前途,包括政治解決的前景、對于東海問題提交國際仲裁結(jié)果的估計和“擱置爭議,共同開發(fā)”的可行性及與臺灣共同合作維護民族權(quán)益的可能性,爭取在維護主權(quán)的前提下盡量以和平談判的方式解決東海問題。
[Abstract]:The East China Sea is one of the three major marginal seas in China. In recent years, China and Japan have delimited the continental shelf of the East China Sea. The article discusses the origin and prospect of the dispute between China and Japan in the East China Sea from the angle of international law. The article first introduces the geographical position and strategic position of the East China Sea and the relationship between China and Japan in the East China Sea. Causes and trends. The provisions of international law relating to the delimitation of the continental shelf are then introduced, The status of the Diaoyu Islands and the Okinawa trough in the delimitation of the continental shelf in the East China Sea is introduced. It also describes the respective understandings of the Diaoyu Islands and the Okinawa trough between China and Japan, and then introduces the position and basis of China and Japan on the delimitation of the continental shelf in the East China Sea. And refutes the inapplicability of the "intermediate line" principle of the Japanese side with international law and jurisprudence. Finally, the article further discusses the solution and future of the East China Sea issue between China and Japan, including the prospect of a political solution. With regard to the estimation of the outcome of international arbitration submitted to the East China Sea issue and the feasibility of "shelving disputes and jointly developing" and the possibility of cooperating with Taiwan in safeguarding the national rights and interests, Strive to resolve the East China Sea issue through peaceful negotiations on the premise of safeguarding sovereignty.
