【摘要】：從1986年9月我國(guó)第一家中外合作辦學(xué)機(jī)構(gòu)南京大學(xué)—約翰·霍普金斯大學(xué)中美文化研究中心成立至今,我國(guó)中外合作辦學(xué)至今大致經(jīng)歷了早期探索時(shí)期、快速興起時(shí)期之后一直走到了今天的成熟發(fā)展時(shí)期,這一時(shí)期我國(guó)中外合作辦學(xué)呈現(xiàn)出欣欣向榮的喜人局面,數(shù)量劇增、范圍擴(kuò)大、合作項(xiàng)目更趨多元化等特點(diǎn)。2001年12月11日,中國(guó)正式加入了WTO并對(duì)教育服務(wù)貿(mào)易做出了具體承諾,這標(biāo)志著我國(guó)中外合作辦學(xué)法律規(guī)范開始融入世界法律體系。 《中外合作辦學(xué)條例》及其實(shí)施辦法的頒布實(shí)施標(biāo)志著中外合作辦學(xué)正式走上了法治化和規(guī)范化的軌道。但是由于我國(guó)教育服務(wù)產(chǎn)業(yè)起步較晚、結(jié)構(gòu)不合理、教育水平較低等原因,在合作辦學(xué)過程中暴露出政策法規(guī)風(fēng)險(xiǎn)、學(xué)位認(rèn)證風(fēng)險(xiǎn)、糾紛及訴訟風(fēng)險(xiǎn)和辦學(xué)質(zhì)量監(jiān)管不到位等較為嚴(yán)重的法律風(fēng)險(xiǎn)。如何改變我國(guó)中外合作辦學(xué)立法層次較低且空白較多、現(xiàn)有的教育公益性原則與WTO/GATS原則相悖、合作辦學(xué)方利益保護(hù)不足、甚至違反國(guó)際法規(guī)則等現(xiàn)狀,有效預(yù)防上述法律風(fēng)險(xiǎn)的產(chǎn)生成為迫在眉睫的任務(wù)。 本文在WTO/GATS框架下,結(jié)合國(guó)際法律原則和規(guī)則,針對(duì)合作辦學(xué)過程中出現(xiàn)政策法規(guī)風(fēng)險(xiǎn)、學(xué)位認(rèn)證風(fēng)險(xiǎn)、糾紛及訴訟風(fēng)險(xiǎn)和辦學(xué)質(zhì)量監(jiān)管不到位等較為嚴(yán)重的法律風(fēng)險(xiǎn),建設(shè)性提出修改相關(guān)教育法律法規(guī)的“非營(yíng)利性”內(nèi)容、完善中外合作辦學(xué)糾紛解決機(jī)制、強(qiáng)化中外合作辦學(xué)機(jī)構(gòu)教育質(zhì)量的法律管理、完善中外合作辦學(xué)國(guó)家之間的學(xué)歷互認(rèn)制度等預(yù)防和化解合作辦學(xué)各種法律風(fēng)險(xiǎn)的措施,以求我國(guó)中外合作辦學(xué)的穩(wěn)步健康發(fā)展。
[Abstract]:From September 1986 China's first Sino foreign cooperative education institution of Nanjing University - Johns Hopkins University Center for Chinese and American studies since its establishment, Sino foreign cooperative education our country has experienced the early exploration period, after the rapid rise period has reached the mature period of development today, this period of Sino foreign cooperation in running schools in China showing a gratifying situation, the increasing number of thriving, to expand the scope of cooperation projects, more diversified characteristics such as.2001 in December 11th, Chinese joined WTO and the education service trade has made specific commitments, marking the school standard law of Chinese foreign cooperation began to integrate into the world legal system.
< > foreign cooperation in running schools and its implementation rules promulgated marking the Sino Foreign Cooperative Education officially on the legalization and standardization of the track. But because the education service industry in China started late, unreasonable structure, low level of education, exposed the risk of policies and regulations in the cooperation in the process of education, degree certificate risk. Disputes and litigation risk and the quality of supervision is not in place and other more serious legal risks. How to change the foreign schools and the low level of legislation blank more cooperation in our country, the education public welfare principle and the WTO/GATS principle existing contrary to the lack of cooperation to protect the interests of parties, even in violation of the rules of international law and the status quo, which effectively prevent the law the risk has become an imminent task.
In this paper, under the framework of WTO/GATS, combined with the principles and rules of international law, policies and regulations for risk of cooperation in the process of education, degree certificate risk, disputes and litigation risk and the quality of supervision is not in place and other more serious legal risks, the construction of proposed to amend the relevant education laws and regulations of the "non-profit" content, improve the Sino foreign cooperative education disputes settlement mechanism, strengthen legal education quality management of Chinese foreign cooperatively run schools, measures to improve the system to prevent and resolve the recognition degree between the countries in the cooperation of Sino foreign cooperation in running schools all kinds of legal risks, to the healthy and steady development of Sino foreign cooperation in running schools in China.
