【摘要】：環(huán)境權(quán)即享有良好環(huán)境的權(quán)利,如清潔空氣權(quán)、清潔水權(quán)、采光權(quán)、通風(fēng)權(quán)、安寧權(quán)和景觀權(quán)等。環(huán)境權(quán)既不包括資源權(quán)、排污權(quán)等與環(huán)境有關(guān)的實(shí)體性權(quán)利,也不包括環(huán)境知情權(quán)、環(huán)境參與權(quán)和環(huán)境監(jiān)督權(quán)等程序性權(quán)利。環(huán)境權(quán)的權(quán)利對(duì)象是環(huán)境而非生態(tài),故不能稱為生態(tài)權(quán)。環(huán)境權(quán)是國(guó)際人權(quán)發(fā)展史上的第三代人權(quán),是生態(tài)文明時(shí)代的標(biāo)志性權(quán)利,是環(huán)境公益訴訟最為重要的權(quán)利基礎(chǔ),是助推環(huán)境司法走出當(dāng)前困境的主要法寶。今后,我國(guó)應(yīng)將確認(rèn)和保障環(huán)境權(quán)作為生態(tài)文明法治建設(shè)的核心任務(wù)之一。
[Abstract]:The right to environment is the right to enjoy a good environment, such as the right to clean air, the right to clean water, the right to light, the right to ventilation, the right to tranquillity and the right to landscape. Nor does it include procedural rights such as the right to know, the right to participate in the environment and the right to supervise the environment. The object of the right to environment is the environment, not the ecology, so it cannot be called ecological right. The environmental right is the third generation of human rights in the history of international human rights development. It is the iconic right in the era of ecological civilization, the most important right foundation of environmental public interest litigation, and the main magic weapon to help environmental justice out of its current predicament. In the future, China should confirm and protect the environmental rights as the core of the construction of ecological civilization of the rule of law Ren Wuzhi.
