【摘要】：自20世紀90年代以來,私營軍事安保公司(Private Military and Security Companies,PMSCs)開始迅速發(fā)展,并越來越多的出現(xiàn)在武裝沖突中。但是,由于私營軍事安保公司雇員的法律地位在國際人道法中沒有被明確,有的學者質疑國際人道法中私營軍事安保公司雇員的地位,并聲稱其活動于“法律真空”中。本文力圖通過對現(xiàn)行國際人道法和有關國際法發(fā)展的分析,對國際人道法下私營軍事安保公司雇員的法律地位加以確定。本文將分為四部分,圍繞以上問題展開論述。第一部分將對私營軍事安保公司雇員做相應的背景介紹,包括其產生、發(fā)展和業(yè)務范圍,以及產生的法律問題。第二部分將嘗試從現(xiàn)有國際人道法條約角度對私營軍事安保公司的雇員進行法律地位的確定,即其為雇傭兵、戰(zhàn)斗員或者平民的可能性。第三部分著重介紹有關私營軍事安保公司雇員法律地位的最新國際法發(fā)展,即由紅十字國際委員會和瑞士政府發(fā)起并由國家達成諒解的《蒙特勒文件》,結合該問題對此文件加以分析。第四部分得出結論:私營軍事安保公司雇員的在國際人道法中的地位是可以被確定的,雇員的活動必須尊重和遵守國際人道法。
[Abstract]:Since the 1990s, private Military and Security PMSCs have grown rapidly and are increasingly emerging in armed conflict. Since the legal status of employees of PMSCs is not clear in international humanitarian law, some scholars question the status of employees of PMSCs in international humanitarian law. This paper attempts to determine the legal status of employees of private military security companies under international humanitarian law through an analysis of existing international humanitarian law and related developments in international law. The first part will give a background introduction to the employees of PMSCs, including their emergence, development and scope of business. And the legal issues that arise. The second part will attempt to determine the legal status of employees of private military security companies in the context of existing international humanitarian law treaties, that is, mercenaries, The possibility of combatants or civilians. Part III highlights recent developments in international law concerning the legal status of employees of private military security companies, The Montreux document, initiated by the International Committee of the Red Cross and the Swiss Government and understood by the State, is analysed in the context of this issue. The status of humanitarian law can be determined, Employees must respect and abide by international humanitarian law in their activities.
