FIDIC土木工程施工合同條件下業(yè)主索賠制度研究

【摘要】:與以往版本不同,1999年第一版《施工合同條件》(新紅皮書(shū))首次單獨(dú)設(shè)立專(zhuān)門(mén)條款對(duì)業(yè)主的索賠做出規(guī)定,旨在平衡以往版本中業(yè)主與承包商在工程索賠方面的權(quán)利不平等的局面。現(xiàn)有研究對(duì)承包商索賠已有不少成果,然而對(duì)于業(yè)主索賠的研究卻相當(dāng)寥寥;诖,本文試圖以新紅皮書(shū)為藍(lán)本,從業(yè)主的角度出發(fā),以法律分析為重點(diǎn),對(duì)FIDIC施工合同條件下的業(yè)主索賠制度加以研究。全文主要從以下三個(gè)部分來(lái)論述FIDIC土木工程施工合同條件下業(yè)主索賠問(wèn)題。 第一章、第二章分別對(duì)FIDIC組織以及《施工合同條件》下的業(yè)主索賠進(jìn)行簡(jiǎn)要概述,明確研究范圍。第三章著重對(duì)業(yè)主索賠權(quán)利進(jìn)行法律分析,梳理FIDIC施工合同條件文本中涉及到業(yè)主索賠的各項(xiàng)條款,并嘗試將這些凌亂分散在各個(gè)條款中的業(yè)主索賠權(quán)利進(jìn)行歸類(lèi),使業(yè)主在主張權(quán)利時(shí)對(duì)自己的權(quán)利更加明確,也更方便實(shí)際操作。第四章通過(guò)分別對(duì)工程師解決爭(zhēng)議程序、爭(zhēng)端裁決委員會(huì)(DAB)解決爭(zhēng)議程序以及國(guó)際仲裁機(jī)構(gòu)仲裁程序的分析,為幫助業(yè)主進(jìn)行有效的工程索賠提供程序支持。從而使業(yè)主進(jìn)行索賠時(shí)不僅有實(shí)體法上的權(quán)利基礎(chǔ),更有程序法上的保障。
[Abstract]:In contrast to previous versions, the 1999 first edition of the conditions of Construction contracts (New Red Book) created for the first time a separate provision to provide for owners' claims, The aim is to balance the unequal rights between the employer and the contractor in the previous version of the project. There has been a lot of research on the contractor's claim, but there has been very little research on the owner's claim. This paper attempts to take the New Red Book as the blueprint, from the owner's point of view, and focus on legal analysis. This paper studies the owner's claim system under the condition of FIDIC construction contract. This paper mainly discusses the owner's claim under the condition of FIDIC civil engineering construction contract from the following three parts. The first chapter, the second chapter, gives a brief overview of the owner's claim under the FIDIC organization and the conditions of the Construction contract, and defines the scope of the research. Chapter three focuses on the legal analysis of the owner's claim right. Combing the terms of FIDIC construction contract, which involves the owner's claim, and trying to classify the owner's claim rights which are scattered in each clause, so that the owner can make his rights clearer when he claims the right. It is also more convenient for practical operation. Chapter IV analyzes the dispute settlement procedures of engineers, the dispute settlement Board (DAB) and the arbitration procedures of international arbitration institutions, respectively. In order to help the owner to carry on the effective project claim to provide the procedure support, thus enables the owner to carry on the claim not only has the substantive law right foundation, also has the procedure law the safeguard.
